CERTIFICATION OF A PROGRAM ENVIRONMENTAL IMPACT

B) That the Program Environmental Impact" Report EIR 91-03 will be amended t
include the comments and documents of those testifying at the public hearing an
responses thereto hereby found to be in good faith and reason by incorporating
copy of the minutes of said public hearings into the report.
C) That the Planning Commission finds and determines that the Environmental Impal
Report EIR 91-03 has been completed in conformance with the Californ
Environmental Quality Act, the state guidelines implementing said Act, and tl
provisions of Title 19 of the Carlsbad Municipal Code and that the Plannir
Commission has reviewed, considered and evaluated the information contained j
the report.
D) That the Environmental Impact Report EIR 91-03 as so amended and as evaluatc
in the staff report (January 6, 1993), is recommended for acceptance ar
certification as the final Environmental Impact Report and that the fin
Environmental Impact Report as recommended is adequate and provides reasonab
information on the project and all reasonable and feasible alternatives theret(
including no project.
E) That potentially significant construction-related air quality impacts would I
mitigation measures to control dust generation and to regulate construction traffi

That the project does not result in significant unmitigatible impacts at the proje
level to solid waste. To reduce cumulative impacts the Carlsbad Ranch project w
implement a recycling program for the proposed project which would include whi
paper, newspaper, glass, plastic and metal recyclables. It is only because of tl
existing solid waste disposal crisis, that the project would have cumulative impac
with respect to solid waste generation. However, buildout of the proposed proje
is not expected before the year 2000, and it is anticipated that the regional proble
of landfill space will be resolved by that time.
G) That each and every significant environmental impact identified in tl
Environmental Impact Report would be overruled or counter balanced by chang
or alteration in the project which would mitigate against said adverse impacts c
in the case of Air Quality and solid waste, that mitigation of such adverse impac
is not feasible under the circumstances and that as a result of economic and soci
considerations a Statement of Overriding Considerations is contained herein,
support the approval of the project.

1. That the following findings are made relative to the conclusions of the Fin
Environmental Impact Report (EIR) for the proposed Carkbad Ranch Specific Pk
and related applications (SCH #92071027) based on the EIR text, including tl
comments and responses to the draft EIR, and all documents, maps, pub1
testimony and illustrations included in the public record.
2. That the EIR will serve as a "Prograrn EIR" by addressing impacts of the initi
project and the subsequent Site Development Plans.
3. That the proposed project involves the construction of up to a total of 1,880,OC
square feet of building area consisting of retail commercial, office/research a~
developmenflght manufacturing, a hotel, and a driving range on 11 7.1 acres ar
the continued agricultural use of the remaining 306.4 acres.
4. That the EIR for the Carlsbad Ranch Specific Plan project concluded that the proje
would not have significant adverse impacts except for significant, unmitigatf
impacts to air quality and cumulatively to solid waste. A statement of overridh
considerations is proposed for these two significant, unmitigated impacts.
5. STATEMENT OF OVERRIDING CONSIDERATIONS:
Section 15093 of the CEOA Guidelines
The decision makers, having reviewed and considered the information contained
the Final EIR, and having reviewed and considered the public record, find that tl
following factors support approval of the project despite any significant impac
identified in the Final EIR and, therefore, make the following statement
Overriding Considerations.
The City of Carlsbad finds that the mitigation measures discussed in the Final El
(EIR 92-03) and the resolutions of approval for the project, specifically Pld
Commission Resolution 3483 for CT 92-07, when implemented, avoid (
substantially lessen most of the significant effects identified in the ER Nonethela
certain significant effects of the project on AIR QUAL,ITY and SOLID WASTE a
unavoidable even after incorporation of all feasible mitigation measures. Wi
regard to these significant impacts, the City has balanced the benefits of the proje
against the unavoidable environmental risks in approving the project. In tf
regard, the City finds that all feasible mitigation measures identified in the EIR, ha7
been or will be implemented with the project, and any significant remaining effec
are acceptable due to the following specific economic, social and 0th
considerations:

a. The study prepared by Alfred Gobar Associates titled, "Fiscal Impact Analysi!
of the Carlsbad Ranch Specific Plan (SP 207)", dated September 199;
demonstrates that the proposed land uses generate a net fiscal benefit pe
acre of development to the City and State except prospective office project
with a floor-area-ratio (FAR) below 0.5 and open space activities. Th(
overall total impact will be a net fiscal benefit. This benefit outweighs thl
marginal cumulative impact created by the project to air quality and soli(
waste.
b. The net fiscal benefit of the project will benefit all citizens of the City o
Carlsbad as funds will be generated which the City Council can dlocatl
amongst various public services and programs desired by the citizens o
Carlsbad.
c. The proposed non-residential uses will create employment opportunitic
within the City which may result in a reduction of mobile source air qualit
emissions as well as providing potential job opportunities for residents.

d. Development of the site is planned for as part of the General Plan and Loa
Facilities Management Plan for Zone 13. Development of the site 2
proposed is necessary in order to generate income to pay the propertic
portion of the Palomar Airport Road Assessment District as well as to fun
improvements identified as part of the Mello-Roos District including th
Palomar Airport Road,/I-5 improvements.

e. The ultimate development of additional office, research and developmen
commercial space, a hotel, and a driving range will provide social, cultm
and economic benefits to the residents of the City by providing additiom
jobs and services in a location closer to their home. Furthermore, th
project will provide significant revenues to the City by way of sales ta:
property tax, and transient occupancy tax.

6.0 MITIGATION MONlTORING AND REPORTING PROGRAM
6.1 INTRODUCTION
On January 1,1989, Assembly Bill 3180 (AB3180) (Cortese) was enacted. AB3180 requires that
public agencies "adopt a reporting and monitoring program for changes to the project which was
adopted or made a condition of project approval in order to mitigate or avoid significant effects
of the environment" The purpose of the law is to establish a reporting or monitoring program
to assure implementation of recommended mitigation measures.
This Mitigation Monitoring and Reporting Program for the Carlsbad Ranch Specific Plan Project
has been developed in compliance with AB3180 and will assist the City of Carlsbad with
mitigation monitoring and reporting. It presents all mitigation monitoring and reporting measures
required in the Environmental Impact Report (EIR) and outlines the procedures which must be
followed to ensure that the mitigation rncasurcs arc implemented. It also identifies
documentation for reporting program when compliance with the mitigation program occurs.
6.2 PROCEDURE FOR IMPLEMENTATION OF PROGRAM
The mitigation measures pnscntcd in this program have been developed to avoid or reduce to
below a level of significance .the potentially significant environmental impacts associated with
implementation of the pmposcd Carisbad Ranch Specific Plan Project. Monitoring will occur at
various stages during the implementation of the monitoring program. Copies of the program will
be kept on file at the City of Carisbad Planning Department. The program will be updated as
appropriate.
