THE MAP ALSO INCLUDES A PROPERTY ON THE WEST SIDE OF PASEO DEL NORTE NORTH OF PALOMAR AIRPORT ROAD AND PEA SOUP ANDERSEN'S. CASE NAME: CARLSBAD RANCH SPECIFIC PLAN OF PALOMAR AIRPORT.ROAD, SOUTH OF FUTURE CANNON CASE NO: CT 92-07 10 I/ WHEREAS, a verified application for certain property to wit; 11 12 13 A Portion of Lot "H" of Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 823, filed in the Office of the County Recorder of San Diego County, November 16, 1892, 14 has been filed with the City of Carlsbad and referred to the Planning Commission; and 15 WHEREAS, said verified application constitutes a request as provided by Tit 16 21 of the Carlsbad Municipal Code; and 17 18 19 WHEREAS, the Planning Commission did, on the 6th day of January, 199 hold a duly noticed public hearing as prescribed by law to consider said request; and 20 11 WHEREAS, at said public hearing, upon hearing and considering all testimor 21 I1 and arguments, if any, of all persons desiring to be heard, said Commission considered i 22 23 factors relating to the Tentative Tract Map. The Planning Commission has, by inclusion of an appropriate condition to this project, ensured that the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Commission has added a condition that a note shall be placed on the final map that building permits may not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project. This project will not cause any significant environmental impacts and a Negativ Declaration has been issued by the Planning Director on November 5, 1992, fa proposed lot 18 only (the remainder of the Tentative Map was analyzed in Prograr EIR 91-03), and RECOMMENDED FOR APPROVAL by the Planning Commission 0: January 6, 1993. In recommending approval of this Negative Declaration th Planning Commission has considered the initial study, the staff analysis, all require' mitigation measures and any written comments received regarding the significar effects this project could have on the environment. 9. This project is consistent with the City's Growth Management Ordinance as it ha been conditioned to comply with any requirement approved as part of the LOC: 25 26 10. This project was subject to Chapter 21.95 of the Carlsbad Municipal Code (Hillsid treatment of the City's hillside resources. 27 Ordinance) and meets all the requirements of that Chapter to ensure the sensitik Facilities Management Plan for Zone 13. 28 PC RES0 NO. 3483 -2- .* I1 a e 1 2 3 4 11. An FIR was prepared for this project and has been recommended far certificati by the Planning Commission. The EIR (EIR 91-03) identified a number potentially significant impacts created by this project and possible mitigati measures to reduce these impacts to a level of insignificance. These mitigati measures have been incorporated into the project through redesign or conditions approval to reduce all impacts to a level of insignificance with the exception of, Quality and Solid Waste for which overriding considerations have been proposc 5 12. The intent of all mitigation measures proposed in EIR 91-03 are contained in tl 6 resolution by way of specific conditions of approval. In some cases the mitigati measures have been modified to: conform to City Policies; or, expanded to mc 7 adequately mitigate the impact; or, tied to a specific phase of construction so tl they could be more easily monitored. If the fees are not paid this application will not consistent with the General Plan and approval for this project will be void. The applicant shall pay park-in-lieu fees to the City, prior to the approval of t final map as required by Chapter 20.44 of the Carlsbad Municipal Code. The applicant shall provide school fees to mitigate conditions of overcrowding in effect at the time of building permit application. Water shall be provided to this project pursuant to the Water Service agreeme between the City of Carlsbad and the Carlsbad Municipal Water District, dated M 25, 1983. This project shall comply with all conditions and mitigation measures which m be required as part of the Zone 13 Local Facilities Management Plan and a: amendments made to that Plan prior to the issuance of building permits. The following note shall be placed on the Final Map. "Prior to issuance of building permit for any buildable lot within the subdivision, the property own shall pay the special development tax in accordance with City Council Resolutic part of building permit application. These fees shall be based on the fee schedl NO. 91 -39". If any condition for construction of any public improvements or facilities, or t payment of any fees in lieu thereof, imposed by this approval or imposed by law 1 this project are challenged this approval shall be suspended as provided Government Code Section 65913.5. As part of the plans submitted for building permit plan check, the applicant sh include a reduced version of the approving resolution/resolutions on a 24” x 2 blueline drawing. Said blueline drawing(s) shall also include a copy of a applicable Coastal Development Permit and signed approved site plan. LAND USE: 30. To ensure that all land use impacts remain at a level below significance, all si specific development plans shall be reviewed for compliance with the Specific Pk as approved and be approved by the Planning Commission prior to the issuance a grading or building permit. In addition, the site-specific development plans w be reviewed for compliance with the conditions of the following: 0 General Plan Amendment; 0 Local coastal Plan Amendment; 0 Land Conservation Contract Amendment; 0 Zone Change; 0 Hillside Development Permit; 0 Coastal Development Permits; and 0 Tentative Map 31. AIR QUALITY - Construction Sources Impacts from dust emissions and construction-related traffic will not be significz if the identified mitigation measures are implemented. For sites, such as CA-SDI-10670 0117-117 14 or portions of sites which do not contain an intact subsurface deposit, mitigation c impacts can be achieved by collection of surface artifacts, analysis of artifacts an 15 a report of finding. For archaeological sites or portions of such sites with an intac deposit, mitigation of impacts can be achieved through the sample excavation of th 16 intact portion of the site, followed by artifact analysis, special studies (i-e., obsidia 17 hydration and radiocarbon dating), and a report of finding. The sample excavatio should provide a two percent random sample followed by an optional three percer 18 excavation, depending on the two percent results. For sites CA-SDI-6132 (W-119 CA-SDI-10670 (W-l17), CA-SDI-10671 (W-l18), and CR-S-1, mitigation of impac (Treatment Plan) prior to approval of a grading pennit, as identified in the City I 19 can be achieved through the completion and acceptance of a data recovery progra 20 concurrent with initiation of grading within 100 of the boundary of the affect( 22 Carlsbad's cultural resource guidelines. 21 Capping of the sensitive area of site CA-SDI-8797 should occur prior to ( area. PALEONTOLOGY 36. Potential impacts to paleontological resources can be mitigated to below a level significance by implementing the following measures: A. Prior to issuance of a mass-grading permit the developer will present a letr to the City indicating that a qualified paleontologist has been retained carry out an appropriate mitigation program. B. A qualified paleontologist will be at the preconstruction meeting to corn with the grading and excavation contractors. C. A paleontological monitor will be onsite at all times during the on@ cutting of previously undisturbed sediments of the Santiago Formation inspect cuts for contained fossils. Periodic inspections of cuts involving t Sweitzer Formation is also recommended. In the instances the paleontologist (or paleontological monitor) will be allowed temporarily direct, divert, or halt grading to allow recovery of fossil remai in a timely manner. E. Fossil remains collected during the monitoring and salvage portion of t mitigation program w;ll be cleaned, rep&ed, sorted, and cataloged. F. Prepared fossils, along with copies of all pertinent field notes, photos, a] maps will be deposited in a scientific institution with pennane paleontological collections. Donation of the fossils will be accompanied an initial specimen storage fee. This fee is determined by the reposita institution, such as the San Diego Museum of Natural History or the S, Bernadino Museum, and is determined by the size and amount of specime recovered. I G.
