PLANNING COMMISSION RESOLUTION NO. 3486
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT TO PLACE A 960 SQUARE
FOOT MODULAR TRAILER ON PROPERTY LOCATED AT
5950 EL CAMINO REAL.

All that portion of Lot B of Rancho Agua Hedionda, in the
County of San Diego, State of California, according to Map
thereof No. 823, filed in the Office of the County Recorder of
San Diego County, November 16, 1896, included in that
certain 6.459 acre parcel of land as shown on Record of
Survey Map No. 7345 on file in the Office of the County
Engineer of said San Diego County. ~

1. That the requested use is necessary or desirable for the development of the
community, as customer service and coordination between district personnel
should improve; is essentially in harmony with the various elements and objectives
of the general plan by improving an administrative facility per the goal of the
public facilities element; and is not detrimental to existing uses or to uses
specifically permitted in the zone in which the proposed use is to be located as
surrounding property is vacant and zoned for office/industrial uses.
2. That the site for the intended use is adequate in size and shape to accommodate
the use because the trailer is contained within the developable portion of the lot;
3. That all of the yards, setbacks, walls, fences, landscaping, and other feature5
necessary to adjust the requested use to existing or permitted future uses in the
neighborhood will be provided and maintained as landscaping already exists and
setbacks, parking, and employee eating areas exceed standards;
4. That the street system serving the proposed use is adequate to properly handle all
traffic generated by the proposed use as only 29 average daily trips will be
generated by the trailer.
5. The proposed project is compatible with the surrounding future land uses since
surrounding properties are designated for industrial and office development on the
General Plan.
6. No environmental impacts are anticipated as the Planning Director has determined
the project to be categorically exempt from environmental review per Section
15301 (e)(1) of the California Environmental Quality Act.
Conditions:
1. Approval is granted for CUP 92-O8/SUP 88-2(A), as shown on Exhibit(s) "A-C":
dated January 20, 1993, incorporated by reference and on file in the Planning
Department. Development shall occur substantially as shown unless otherwise
noted in these conditions.
2. Approval of this request shall not excuse compliance with all sections of thc
Zoning Ordinance and all other applicable City ordinances in effect at time ol
building permit issuance.
3. Approval of CUP 92-08 is granted subject to the approval of SUP 88-02(A).
4. This conditional use permit is granted for a period of 5 years. This conditional usc
permit shall be reviewed by the Planning Director on a yearly basis to determinc
if all conditions of this permit have been met and that the use does not have 2
significant detrimental impact on surrounding properties or the public health anc

welfare. If the Planning Director determines that the use has such significsll
adverse impacts, the Planning Director shall recommend that the Pl&
Commission, after providing the permittee the opportunity to be heard, ad
additional conditions to mitigate the significant adverse impacts. This permit mz
be revoked at any time after a public hearing, if it is found that the use has
significant detrimental affect on surrounding land uses and the public’s health ar
welfare, or the conditions imposed herein have not been met. This permit may 1
extended for a reasonable period of time not to exceed 5 years upon writtc
application of the permittee made no less than 90 days prior to the expiratic
date. In granting such extension, the Planning Commission shall find that r
substantial adverse affect on surrounding land uses or the public’s health ar
welfare will result because of the continuation of the permitted use and that tl
continued operation of the trailer as a temporary use is acceptable in lieu of
permanent facility. If a substantial adverse affect on surrounding land uses or tl
public’s health and welfare is found, the extension shall be considered as b
original application for a conditional use permit. There is no limit to the numb€
of extensions the Planning Commission may grant.
5. All roof appurtenances, including air conditioners, shall be architectural
integrated and concealed from view and the sound buffered from adjacex
properties and streets, in substance as provided in Building Department Policy Nc
80-6, to the satisfaction of the Directors of Planning and Building.
