HomeMy WebLinkAbout1993-02-03; Planning Commission; Resolution 3443Ii 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 ~ 21 22 I 23 24 0 0 PLANNING COMMISSION RESOLUTION NO. 3443 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM EXISTING DESIGNATIONS TO PROPOSED DESIGNATIONS ON PROPERTY GENERALLY LOCATED IN THE SOUTHERN PORTION OF THE BEACH AREA OVERLAY ZONE. CASE NAME: BEACH AREA LAND USE STUDY CASE NO: ZC 92-01 WHEREAS, a verified application for certain property, located as shown on Exhibits "A" - "C", dated February 3,1993, attached and incorporated herein, has been fled with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 3rd day of February, 1993, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZC 92-01, as shown on Exhibit "BI', based on the following findings and subject to the following conditions. 25 I *.*. 26 .... 27 28 (I 0 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 Fhb: 1. The proposed zone changes are responsive to the goal of addressing neighborhood family zoning mixture within the study area. The proposed R-2 zoning will promote compatible development standards and a community with appropriate size and scale. 2. The proposed zone changes will eliminate existing General Plan conflicts and compatibility while neutralizing the extremes of the existing single family vs. multi- inconsistencies with General Plan designations within the study area. 3. All findings of Resolution No. 3441, GPA 92-09, and Resolution 3442, LCPA 92-02 are incorporated herein by reference. Conditions: 1. Approval is granted for ZC 92-01 as shown on Exhibits "A" - "C", dated February 3, 1993. 2. Approval of ZC 92-01 is granted subject to the approval of GPA 92-09 and LCPA 92- 02. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 3rd day of February, 1993, by the following vote, to wit: AYES: Chairperson Noble; Commissioners: Schlehuber, Schramm, Welshons, Savary, Erwin & Hall.
