HomeMy WebLinkAbout1993-02-03; Planning Commission; Resolution 34940 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 PLANNING COMMISSION RESOLUTION NO. 3494 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN EXTENSION OF A CONDITIONAL USE PERMIT ALLOWING THE STORAGE AND MAINTENANCE OF CLASSIC, VINTAGE, INVESTMENT QUALITY AUTOMOBILES ON PROPERTY GENERALLY LOCATED AT 2039 LOKER AVENUE IN THE PM ZONE. CASE NAME: STARS & STRIPES MOTORSPORTS CENTER CASE NO: CUP 90-08x1 WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did, on the 3rd day of February, 1993, hold a duly noticed public hearing to consider said application on property described as: Parcel C of Parcel Map 15562, in the City of Carlsbad, County of San Diego, State of California, filed in the office of the County Recorder February 9, 1989 as File No. 89-070363 of Official Records. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to CUP 90-08. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. The proposed use is necessary and desirable for the development of the community and is in harmony wid the various elements and objectives of the General Plan since it is consistent with storage uses permitted by Specific Plan 200 and the P-M Zone, as well as Chapter 21.42 of the Zoning Ordinance allowing large assemblages of automobiles in the P-M Zone upon approval of a Conditional Use Permit. The proposed storage of large numbers of automobiles in an existing wareho~~ facility, as conditioned, is not detrimental to surrounding uses specifically permitted within the P-M Zone since the proposed site in the carlsbad Oaks Business Park is an existing office/warehouse building surrounded by other industrial buildings in which office, manufacturing and warehouse uses are permitted. 2. The site for the intended use is adequate in size and shape to accommodate the proposed storage, maintenance, and investment service uses since no alteration to the existing project is required, and all proposed activities will occur within the structure as required by Specific Plan 200 and the PM Zone. 3. The proposed site was approved by Planned Industrial Permit PIP 894 for office and warehouse uses; the PIP approval ensures its compliance with all development standards imposed by Specific Plan 200 and the P-M Zone. A total of 53 parking spaces are provided onsite for the estimated 15 employees as well as clients and Visitors. Since all activities are proposed to occur within the structure, no alteration of the site is required. 4. The Stars & Stripes Motorsports Center is located within de Carlsbad Oaks Business Center where the street system is adequate to handle all trafhc generated by existing and future permitted and/or conditionally permitted uses. Conditions: 1. All conditions of approval imposed upon CUP 90-08 as stated in Planning Commission Resolution 3158 shall apply as Conditions of approval for CUP 90-08x1 except as amended by Condition No. 2. 2. This conditional use permit is granted for a period of 5 years 2 months and 27 days or from November 7, 1992 through February 3,1998. This conditional use permit shall be reviewed by the Planning Director on a yearly basis to determine if all conditions of this permit have been met and that the use does not have a significant detrimental impact on surrounding properties or the public health and welfare. If the Planning Director determines that the use has such significant adverse impacts, the Planning Director shall recommend that the Planning Commission, after providing the permittee the opportunity to be heard, add additional conditions to mitigate the significant adverse impacts. This permit may be extended for a reasonable period of time not to exceed 5 years upon writter application of the permittee made no less than 90 days prior to the expiratior date. In granting such extension, the Planning Commission shall find that no substantial adverse affect on surrounding land uses or the public’s health and welfare will result because of the continuation of the permitted use. If a substantial adverse affect on surrounding land uses or the public’s health and welfare is found, the extension shall be considered as an original application for a conditional use permit. There is no limit to the number of extensions the Planning Commission may grant. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 3rd day of February, 1993, by the following vote, to wit: AYES: Chairman Noble; Commissioners: Schlehuber, Schramm, Welshons, Savary, Erwin & Hall.
