CASE NAME: RANCHO CARRILLO MASTER PLAN CASE NO: MP 139[E) WHEREAS, a verified application for an amendment to the Rancho Carrill Master Plan for certain property to wit: A portion of the southerly one half of Section 18 and a portion of Section 19, Township 12 South, Range 3 west, San Bernardino Meridian and a portion of fractional Section 13 and a portion of fractional Section 24, township 12 South, Range 4 West, San Bernardino Meridian, City of Carlsbad, county of San Diego, State of California. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request for amendmen as provided in Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 7th day of April, 1993 and on the 21st day of April, 1993, hold a duly noticed public hearing as prescribed bl law to consider said request; WHEREAS, at said public hearing, upon hearing and considering a1 testimony and arguments, if any, of all persons desiring to be heard, said Commissiol considered all factors relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissior of the City of Carlsbad, as follows: AI That the above recitations are true and correct. Bl That based on the evidence presented at the public hearing, the Commissiox recommends APPROVAL, of MP-l39(E), based on the following findings. . .. 0 0 1 2 3 4 5 6 7 8 9 Findings: 1. The proposed development as described by the Master Plan is consistent with th provisions of the General Plan as identified within the findings for GPA 91-06 Resolution No. 3505 and all findings of said resolution are incorporated herein b reference. 2. All necessary public facilities can be provided concurrent with need and adequatc provisions have been provided to implement those portions of the capita improvement program applicable to the subject property. The Master Plan ha language in the text stating that all future development shall comply with th~ public facility performance standards and phasing requirements of the bca Facilities Management Plan (LJMP) for Zone 18. Public facilities are required tc be constructed as development in the Master Plan creates demand for additiona facilities. The residential and open space portions of the community will constitute a~ environment of sustained desirability and stability, and that it will be in harmoq with or provide compatible variety to the character of the munding area, anc that the sites proposed for public facilities, such as schools, playgrounds, anc parks, are adequate to serve the anticipated population and appear acceptable tc the public authorities having jurisdiction thereof. The Open Space plan provides 250 acres of open space within the Master Plar which is to be used for the protection of biological habitat, the migration o. wildlife, trails for hikers and bicyclists, recreation, visual aesthetics, and buffer! from developed areas. As noted by reference in Finding No.1, all development is in harmony with a compatible variety to the character of the surrounding area. In recognition of the community's namesake's element of heritage and provision of time and place, 2 Special Design Park District has been established which covers the ar~ surrounding the Community Park site to ensure compatibility- On February 22, 1992 the Parks and Recreation Commission voted in favor oj accepting the parkland dedication as offered by the property owners. On February 23,1993 the San Marcos Unified School District Board directed thei staff to pursue the dedication of the school site as so identified within the Masta Plan. 25 4. In the case of institutional, recreational, and other similar nonresidential uses, sud development will be proposed, and surrounding areas are protected from an adverse effects from such development. The Rancho Carrillo Community Park, th Public School Site, and the Day Care Site and Community Recreation Area are a located adjacent to each other. They are bound to the north and east b Circulation Ezement roadways, on the west by Open Space, and to the south b: collector streets and significant landscaped slopes and setbacks to ensure tha surrounding areas are protected from any adverse effects. 6. The streets and thoroughfares proposed are suitable and adequate to carry th, anticipated traffic thereon. Traffic studies have been completed for the Loa Facilities Management Plan for Zone 18 and EIR 91-04. Compliance with th mitigation conditions required by these studies and plans would ensure that al circulation infrastructure is in place to serve the traffic demands generated b: buildout of the Master Plan. 7. Commercial development cannot be justified economically at the location proposec due to the proximity of multiple commeraal land use sites within one and one hal mile radius of the Master Plan. 8. Appropriate measures are proposed to mitigate any adverse environmental impac as noted in the adopted environmental impact report for the project. All finding of EIR 91-04, Resolution No. 3503 are incorporated herein by reference. 9. The area surrounding the development is or can be planned and zoned ir coordination and substantial compatibility with the development. The project ha! extensive open space buffers on the east, west, and south- Where the project abut! existing single family it is proposing single family. Where the project abut! existing multi-family it is proposing multi-family or less intensive land uses. When the projects abuts Circulation Element Roadways it has been conditioned to compls with the Citfs adopted noise policies. The amendment is therefore consistent ani compatible with the surrounding land uses and with the policies of the Gen& Plan. Conditions: 1. All conditions of EIR 91-04, MP 139(E), and HDP 91-17, as contained in Planning Commission Resolutions Nos. 3503,3504, and 3506, respectively, are incorporated herein by reference. Refer to those documents for all conditions and mitigatior measures applicable to development of the Rancho Carrillo Master Plan. ... ... ...
