L ** _- * I 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I I PLANNING COMMISSION RESOLUTION NO. 3506 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL, OF A HILLSIDE DEVELOPMENT PERMIT ON PROPERTY GENERALLY LOCATED SOUTH OF PALOMAR AIRPORT ROAD, NORTH OF LOCAL FACILITIES MANAGEMENT ZONE 6, EAST OF BRESSI RANCH, AND WEST OF THE EASTERN CITY LIMITS. CASE NAME: RANCHO CARRILL0 MASTER PLAN CASE NO: HDP 91-17 WHEREAS, a verified application for certain property to wit: A portion of the southerly one half of Section 18 and a portion of Section 19, Township 12 South, Range 3 west, San Bernardino Meridian and a portion of fractional Section 13 and a portion of fractional Section 24, township 12 South, Range 4 West, San Bernardino Meridian, City of Carlsbad, County of San Diego, State of California. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request for amendment as provided in Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 7th day of April, 1993, and on the 21st day of April, 1993, hold a duly noticed public hearing as prescribed by law to consider said request; WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad, as follows: A) That the above recitations are true and correct. ~ i I S’ 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 I I Ii 0 0 B) That based on the evidence presented at the public hearing, the Commissior recommends APPROVAL of HDP 91-17, based on the following findings and subject to the following conditions. Findings: 1. Hillside conditions have been properly identified on the Constraints Map for thc project. Proposed grading of Wo and greater slopes is in conformance with tht exclusions allowed by Section 21.95.090 of the Hillside Development Regulations. 2. Undevelopable areas of the project have been propeily identified on tht Constraints Map for the project as well as in EIR 91-04 for the Rancho Carrill( Master Plan Amendment. 3. The development proposal and all applicable development approvals and permit are consistent with the purpose, intent, and requirements of the Hillsid1 Development Regulations since the EIR identifies that the hillside alteration wil not result in substantial damage or alteration of significant natural resource areas wildlife habitats, or native vegetation areas. 4. No development or grading will occur in those portions of the property which an undevelopable pursuant to the provisions of Section 21.53.230. 5. The project design and lot configuration minimises disturbance to hillside lands tc the greatest extent feasible given the impact of three Circulation Element roadway traversing the natural topography of the site. 6. The project design substantially conforms to the intent of the concepts illustrata in the hillside development guidelines manual in that contour grading, thi screening of graded slopes by landscaping, buildings, and ~t~ral topographi features is proposed, view preservation and enhancement is identified, anc roadway design is not defined by wide straight alignments with the exception o the Circulation Element roadways. 7. EIR 91-04 was prepared for this project and has been recommended fo certification by the Planning Commission EIR 91-04 identified a number a potentially significant impacts created by this project and possible mitigati01 measures to reduce these impacts to a level of insignificance. These mitigati01 measures have been incorporated into the project through redesign or condition of approval. 8. The site requires extensive grading to accommodate circulation element roadway Of the 6,950,700 cubic yards of cut, 3,148,400 cubic yards directly relate to th circulation element roadways. 10. The proposed modification will result in significantly more open space c undisturbed area than would a strict adherence to the requirements of 21.90.06( while the intent is to minimize the amount of modification to hillside propertie the measurement of relative sensitivity is accomplished by the grading volum divided by the total area graded. This encourages grading of larger areas to low€ the overall grading volume per acre. Limiting slopes to thirty feet in height resdi in greater horizontal areas required to cover the same vertical distances. B allowing slopes over 30 feet the Master Plan provides more adequate buffers fro1 sensitive areas identified within the EIR as well as limits the physical extent of th development. 11. Analysis of multiple alternatives for circulation element roadway alignmen1 indicates that due to both environmental and topographical constraints there is n feasible alternative consistent with the Hillside Development regulations. Conditions: 1. All conditions of EIR 91-04, MP 139(E), and GPA 91-06, as contained in Plannin Commission Resolutions Nos. 3503,3504, and 3505, respectively, are incorporate herein by reference. Refer to those documents for all conditions and mitigatio measures applicable to development of the Rancho Canillo Master Plan. 2. Approval is granted for HDP 91-17 as shown on exhibits dated April 7, 199: incorporated by reference and on file in the Planning Department. Developmer shall occur substantially as shown unless otherwise noted in these conditions. 3. Approval of HDP 91-17 is granted subject to the certification of EIR 91-04 and th approval of GPA 91-06 and MP 139(E). 4. Prior to issuance of a grading permit, the applicant shall deposit, at a finan& institution subject to regulation by the state or federal government, a certificat of deposit or letter of credit made out to the City of Carlsbad or such othc security which is acceptable to the city. this document shall be for at least twic the estimated cost of the proposed mitigation and landscaping for the portions c the site requesting a modification to the design standards. .... ....
