1 PLANNING COMMISSION RESOLUTION NO. 3512
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF WSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A MASTER PLAN TEXT AMENDMENT TO
ALLOW THE PLANNING COMMISSION TO BE THE FINAL
DEVELOPMENT PLANS WITH 50 OR MORE UNITS.
CASE NAME: AVIARA SITE DEVELOPMENT PLAN
CASE NO: MP 177(I)
DECISION-MAKING BODY FOR RESIDENTIAL SITE
7 WHEREAS, a verified application has been filed with the City of Carlsbad anc
8 referred to the Planning Commission; and
9 WHEREAS, said verified application constitutes a request as provided by Tit11
lo // 21 of the Carlsbad Municipal Code; and

A) That the foregoing recitations are true and correct.

Conditions:
1. Approval is granted for MP 177(1), as shown in Exhibit "x", dated March 17, 1992 attached.
2. Approval of this request shall not excuse compliance with all sections of the ZO&
Ordinance and all other applicable City ordinances in effect at time of approval c
the master plan amendment.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the Plannin
Commission of the City of Carlsbad, California, held on the 21st day of April, 1993, by th
following vote, to wit:
AYES: Chairman Noble, Commissioners: Schlehuber, Schramn
Welshons, Savary, Erwin & Hall.
NOES: None.
ABSENT: None.
ABSTAIN: None.

SECTION III(B)(2) of the Aviara Master Plan MP 177 currently reads as follows:
"All site development plans and tentative subdivision maps shall be reviewed by the
Planning Commission and City Council with the exception that residential Planning
Areas which include less than 50 dwelling units shall be reviewed solely by the
Plamhg Commission unless appealed. A site development plan shall not be
approved unless the decision making bodies determine that the individual plan is
consistent with the concepts, goals and standards described in this Master Plan and
all applicable City policies and laws."
SECTION III(B)(2) is recommended to be amended to read as follows:
"All site development plans and tentative subdivisions maps which include 50 or
more dwelling units shall be reviewed by the Planning Commission and City
Council, with the exception that residential Planning Areas which include 50 or
more dwelling units that have an approved tentative subdivision map shall be
reviewed solely by the Planning Commission unless appealed. All residential site
development plans and tentative subdivision maps which include less than 50
dwelling units shall be reviewed solely by the Planning Commission unless appealed.
A site development plan shall not be approved unless the decision making bodies
determine that the individual plan is consistent with the concepts, goals and
standards described in this Master Plan and all applicable City policies and laws."
