CASE NAME: CARLSBAD GIRLS CLUB CASE NO: CUP 150(B) WHEREAS, the Planning Commission did on the 5th day of May, 1993, hc a duly noticed public hearing as prescribed by law to consider said request, and WHEREAS, at said public hearing, upon hearing and considering all testimo: and arguments, examining the initial study, analyzing the information submitted by sta 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 and considering any written comments received, the Planning Commission considered factors relating to the Negative Declaration. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Planni~ Commission hereby APPROVES the Negative Declaration according to Exhibit "NE dated April 1, 1993, and "PII", dated March 23, 1993, attached hereto and made part hereof, based on the following findings: FhdhES: 1. The initial study shows that there is no substantial evidence that the project mi have a significant impact on the environment, since the subject site is an inf location in an existing residential neighborhood. 2. The site has been previously graded pursuant to an earlier environmental analys: 3. The streets are adequate in size to handle traffic generated by the proposed proje which is projected to equal about 350 Average Daily Trips (ADT). ENVIRONMENTAL IMPACTS STATE CEQA GUIDELINES, Chapter 3, Article 5, section 15063 requires that the City conduct Environmental Impact Assessment to determine if a project may have a significant effect on the environme The Environmental Impact Assessment appears in the following pages in the form of a checklist. This ched 8 identifies any physical, biological and human factors @at might be impacted by the proposed project a provides the City with information to use as the basis for deciding whether to prepare an Environmen Impact Report or Negative Declaration. * A Negative Declaration may be prepared if the City perceives no substantial evidence that the project any of its aspects may cause a significant effect on the environment. On the checklist, "NO' will be checE to indicate this det&tion. * An EIR must be prepared if the City determines that there is substantial evidence that any aspect of 1 project may cause a siprnificant effect on the environment. The project may qualify for a Nest Declaration however, if adverse impacts are mitigated so that environmental effects can be deen insidcant. These findings are shown in the checklist under the headings "YES-sig" and 'YES-ixx respectively. The Girls Club is an existing use on the site within an established residential neighborhood ac from Holiday Park. The use is allowed in the area through the approval of a Conditional Permit. The proposed two. phased use expansion will not alter the land uses of the area. 18. The project will not affect the current adequacy of public utilities, services, police or fire protect 19. The project will generate a total sewer demand of 4 Equivalent Dwelling Units which will not rt in the need for new or modified sewer systems, solid waste or hazardous waste control syste 20. The proposed use expansion will result in an, intensification of the Girls Club use which c potentially increase the existing noise levels generated from the site. This impact is not signific however, because all building setbacks will be observed, the site will be buffered from adja properties by a masonry wall and landscaping; and most of the Club's activities will take 1 indoors except for the rear yard area. 21. Ornamental lighting will be provided in the parking area, however, the proposal will not prol a significant amount of light or. glare. 22. No hazardous materials or risk of upset is involved in the Girls Club functions or operations. project will not involve the release of oils, chemicals, pesticides or hazardous materials. 23. No residential density is proposed with the Girls Qub use or two phased expansion. The prop improvements to the Girls Club will not impact the densities or development potentia residential properties within the project area. 24. No housing units exist on the project site and the Girls Club use will not create any demand additional housing. 25/26. The two phased expansion of the Girls Club will ultimately add about 9,960 sq. ft. of floor including the addition of the Head Start Program, so there will be an increase in the amou traffic generated by the site. There will also be an increase in the demand for parking SI onsite. These impacts are not significant since the site design and parking area complies wi~ Engineering standards, an unsafe or congested parking/parking lot circulation situation will n created and the number of parking spaces provided is sufficient to adequately senre both phas this proposal. 27. All proposed improvements are located on the applicant's property so there will be no traftj hazards to motor vehicles, bicyclists or pedestrians created. The internal circulation system meel all City standards. 0. This project will have no impact on the adequacy of City emergency response procedures ( evacuation plans. 1. No scenic vistas are visible from or through the project site and the building's design will be a architectural contribution to the neighborhood which will comply with all applicable develop me^ standards. '2. h major opportunity for recreation in the City exists within Holiday Park which is directly we: across the street from the Girls Club. This proposal will have no impact on the quantity or quali of the recreational value of Holiday Park. -8- a a 4NALYSIS OF VIABLE ALTERNATIVES TO THE PROPOSED PROJECT SUCH AS: a) Phased development of the project, b) alternate site designs, c) alternate scale of development, d) alternate uses for the site, e) development at some future time rather than now, f) alternate sites for the proposed project, and g) no project alternative. a) Phasing is proposed with this project. Further phasing is not necessary from a financial planning/design standpoint and would not be the difference in creating an environmentally super project. b) Alternate site designs were explored by the applicant but the site design proposed meets functional requirements of the Girls Club while complying with applicable development standax c) Alternate scales of development were also explored by the applicant. The first phase of proposal reflects the immediate financial capabilities of the Girls Club. As the City grows and demand for this community use increases, the second phase or master buildout of the Girls C is projected to meet that long tern need. The ultimate scale of the Girls Club use as proposec reasonable given the status of this use as an established community institution and the project 7 comply with all applicable development standards. d) Agriculture on a small scale currently occurs on the north side of the site, but this has only bc an interim use until funding was available for the Girls dub to plan their improvements. Un the R-1 zone, the site could develop with single family residences. However, the Girls Club us! allowed with a conditional use permit and may continue to be allowed through the CUP'S ann reviews and periodic renewals to insure compatibility with adjacent properties and uses. e) The need is now for the Girls Club to expand their services and modernize their facilities; as I as the immediate need to provide space for the city's Head Start Program. The proposed pha of this project will insure that the ultimate site improvements will occur when appropriate fro. financial as well as planning/design standpoint. f) No other sites realistically exist for the expansion of the Girls Club since only the subject sit owned by the Gkis Club and the there is ample area onsite for the phased development tha proposed. g) The no project alternative would leave the Girls Club unable to respond to the growing dm for their services and programs. -9- .? 0 8 lETERMINATlON (To Be Completed By The Planning Department) On the basis of this initial evaluation: - X I find the proposed project COULD NOT have a significant effect on the environment, and a NEGATIV DECLARATION will be prepared. - I find that the proposed project COULD NOT have a significant effect on the environment, because tl environmental effects of the proposed project have already been considered in conjunction wil previously certified environmental documents and no additional environmental review is require Therefore, a Notice of Detennination has been prepared. - I find that although the proposed project could have a significant effect on the environment, there w not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project.
