HomeMy WebLinkAbout1993-06-16; Planning Commission; Resolution 35166. -. .? 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 2o I 21 22 23 24 25 26 27 28 e 0 PJANNING COMMISSION RESOLUTION NO. 3516 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FROM RL TO OS, OS TO RL, OS TO RLM, RLM TO OS, AND RMH TO OS ON PROPERTY GENERALLY LOCATED IN THE NORTHEAST QUADRANT OF THE CITY, IN THE CALAVERA HILLS MASTER PLAN IN LOCAL FACILITIES MANAGEMENT PLAN ZONE 7. CASE NAME: CALAVERA HEIGHTS CASE NO: GPA 90-04 WHEREAS, a verified application for an amendment to the General Plar designation for certain property located, as shown on Exhibit GPA 90-04, dated June 16: 1993, attached and incorporated herein, has been filed with the Planning Commission: and WHEREAS, said verified application constitutes a request for amendmenl as provided in Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 16th day of June, 1993 hold a duly noticed public hearing as prescribed by law to consider said request; WHEREAS, at said public hearing, upon hearing and considering a1 testimony and arguments, if any, of all persons desiring to be heard, said Commissior considered all factors relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning CommissioI of the City of Carlsbad, as follows: A) That the above recitations are true and correct. Bl That based on the evidence presented at the public hearing, the Commissior recommends APPROVAL of GPA 90-04, according to Exhibit GPA 90-04 attached hereto and made a part hereof, based on the following finding and subject to the following conditions. The proposed open space area is equal to or greater than the area depicted on tht official Open Space and Conservation Map, because the proposal to adjust tht open space boundaries results in the deletion of 7.6 acres of open space and tht addition of 27.7 acres of open space, with an overall net gain of 20.1 acres o General Plan open space. 2. The proposed open space area is of environmental quality equal to or greater thar that depicted on the Official Open Space and Conservation Map, because the ope^ space areas proposed to be deleted by GPA 90-05 were not identified as haviq simcant biological habitats based on the biological evaluation in EIR 90-05. II all cases the replacement areas of open space would be equal in biological valu to the deleted areas. In Viges 'W, X, and Y" a small area of Coastal Sage Scrub Chapd Scrub Mix habitat would be deleted from open space and a much large connected area of Burned/Coastal Sage Scrub-chaparral Scrub Mix habitat woulG be added into protected open space. In Village "K!' no open space would deleted however, a large area of Coastal Sage Scrub-Chaparral Scrub Mix would be addel into open space. In Vie "U" and "H" there is a balanced tradeaff between tht loss and gain of the same type of habitat, (disturbed grassland). 3. The proposed adjustment to open space as depicted on the mad Open Space ani Conservation Map, is contiguous or within close proximity to open space as show on the Open Space Map, because in all cases when open space is deleted in : village, equal or greater open space "give-back" area is provided in the samt village. In Vdlages W, X, and Y" the "give-back" area is contiguous to existiq General Plan open space and would connect open space in the northeasten portion of Vige "W" with designated open space in the southwestern portion 0: Village T. The addition of open space in the southern portion of Villages W, X and Y" would also provide an open space buffer between the proposed and existiq residential developments and adjacent properties to the south of the master plat Conditions: 1. All conditions of the EIR 90-05, and MP 150(G) as contained in Resolution Nos. 3515 and 351 7, are incorporated herein by reference. Refer to those document: for all conditions and mitigation measures applicable to the development of tht proposed project. 2. Approval of GPA 90-04 is granted subject to the certification of the EIR 90-05 ani approval of MP 15O(G). ... ... ...
