HomeMy WebLinkAbout1993-07-21; Planning Commission; Resolution 35314 /I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION IRESOLUTION NO. 3531 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO TITLE 18, CHAPTER 18.20 SECTION 18.20.085 TO ENSURE CONSISTENCYWITH PROPOSED AMENDMENTS TO TITLE 21; AND A ZONE CODE AMENDMENT AMENDING TITLE 21, CHAPTER 21.41, OF THE CARLSBAD MUNICIPAL CODE, BY THE ADDITION OF SUBSECTIONS 21.41.030(1)(2)(5)(7)(11)(14) AND (19) WHICH FURTHER DEFINES TERMS ASSOCIATED WITH "A" FRAME SIGNS AND PROJECTING AND AWNING SIGNS, AMENDMENT OF SECTION 21.41.050 WHICH DEFINES THE ORDINANCES APPLICABILITYy ADDITION OF SUBSECTIONS 21.41.070(10) AND (11) WHICH ADDS STANDARDS FOR PROJECTING AND AWNING SIGNS, AND THE ADDITION OF SECTION 21.41.077 WHICH ADDS STANDARDS FOR "A" FRAME SIGNS. CASE NAME: CITY OF CARLSBAD CASE NO: ZCA 93-04 WHEREAS, the Planning Commission did on the 21st day of July, 1993, hol a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimon and arguments, if any, of all persons desiring to be heard, said Commission considered a factors relating to the Zone Code Amendment. NOW, THEREFOREy BE IT HEREBY RESOLVED by the Planning Commissio as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissia recommends APPROVAL of ZCA 93-04, according to Exhibit ''X?, dated Jd 21, 1993, attached hereto and made a part hereof, based on the followin findings. The Zone Code Amendment will not cause any significant environmental impac and a Negative Declaration has been issued by the Planning Director on April 2' 1993, and recommended for approval by the Planning Commission on July 2 1993. CASE NAME: "A" FRAME SIGNS CASE NO: ZCA 93-04 The City Council of the City of Carlsbad, California, ti ';I (3 !b does ordain as follows: SECTION 1: That Title 18, Chapter 18.20, Section 18.20.085 shall be amended to read as follows: "The following types of temporary signs may be erected IO without permit or fee, but shall be subject to the provisions of this chapter: Code) temporary signs less than four square feet except vfAvv Frame 12 signs and Directory "All frame signs as defined in Chapter 21.41 of this Code. 1:3 (2) A temporary sign descriptive of a building under construction or proposed to be constructed and denoting the 14 architect , engineer, contractor, or financier when placed entirely upon private property; provided that no such sign for 15 private construction in a residential district shall have an area in excess of twelve square feet; and provided, further, that every 16 such sign shall be removed immediately upon completion of the .work. 11 1'7 113 19 21.41.030(1) (2) (5) (7) (11) (14) and (19) in alphabetical order to 20 read as follows and renumber the current subsections accordingly: 2:L I1 (1) lIAl1 frame sign means a freestanding sign 22 Jsually hinged at the top, or attached in a similar manner, and widening at the bottom to form a shape similar to the letter trArl. 2:3 Such signs are designed to be portable and are not affixed to any object, structure or the ground. including, but not limited to, adhesive substances or suction. 2!j (5) "Awning or Canopy Sign" means a sign which is printed on, painted on, or attached to an awning or canopy. 26 (7) llDirectory *tAtl frame" sign means a single sign for a group of businesses (not a single sign for a single 2'7 business) within a pedestrian courtyard arcade or mall. (7) A-Frame signs except Directory llAtt Frame signs 1.4 after January 1, 1995. 15 SECTION 4: That Title 21, Chapter 21.41, Section 1,s 21.41.070 is retitled and the first paragraph is amended to read 117 -as follows: 119 l13 /standards : I* 213 SECTION 5: That Title 21, Chapter 21.41, Section 2:~ 21,41,070 is amended .to add subsections 21.41.070(11) and 2<2 21.41.070(12) as follows: 21.41.050 is amended to add subsection 21.41.050(6) and 21.41.050(7) as follows: "DeveloDrnent Standards. Signs shall be subject to the .following development "(11) Projecting and hanging signs shall be 2'3 /Ipermitted subject to the following conditions: 2 4 2 :5 2 6 217 illuminated only. Internally illuminated projecting or hanging (A) No more- than one such sign shall be permitted for each separate business. (B) The area of such signs shall not exceed six square feetper face notwithstanding the provisions of Section 21.41.070(2). (a) Directory ggA1l frame signs shall be allowed under the following conditions: (1) The maximum area of the sign shall be ten square feet per face, notwithstanding the provisions of Section 21.41.070. (2) glAgg frames shall have a maximum of two faces per sign. (3) The maximum width of the sign shall be three feet . (4) The maximum height of the sign shall be five feet . (5) Signs shall be either square or rectangular. (6) A maximum of one Directory IIAgg frame sign per complex is permitted. (7) Every sign and all parts, portions and materials shall be manufactured, assembled and erected in compliance with all applicable State, Federal and City regulations and the Uniform Building Code and shall be of a durable material. (8) All sign parts, portions, and materials shall be kept in good repair. The signs shall be stable. The display surface of all signs shall be kept clean, neatly painted, and free from rust and corrosion. Any cracked, broken surfaces, missing sign copy or other unmaintained or damaged portion of a sign shall be repaired or replaced or removed within 30 calendar days following notification by the City. (9) No such sign shall be closer than ten feet from any other sign permitted by this section. (10) Signs shall not be placed in such a way as to interfere with pedestrian or vehicular sight lines as specified by the City of Carlsbad. (11) Signs shall not be placed in such a way as to obstruct access to a public street, driveway, parking space, fire door, fire escape, handicapped access or in such a way that it obstructs free passage over any public right-of-way. (12) Signs shall not obscure or interfere with the effectiveness of any official notice or public safety sign or device. Signs shall not simulate in color or design a traffic 3 0 e sign or signal , or make use of words, symbols or characters in 1- such a manner as may confuse pedestrian or vehicular traffic. (13) Signs shall not be permanently affixed to any 5: object, structure or the ground including utility poles, light poles, trees, or any merchandise or products displayed outside 2s permanent buildings. (14) The signs shall only be located in front of 1~ buildings to which they relate. (b) Notwithstanding the provisions of Chapter !j 11.16 of the Municipal Code, I'AII frame signs may be located within the public right-of-way subject to the requirements of this (5 section. (c) The signs shall be prohibited on .public '7 and private property abutting prime arterial and major arterial streets and scenic corridors except in the redevelopment area. 13 (d) Other I1AI8 frame signs. ttAtf frame signs other than Directory IgA1I !3 frame signs shall be permitted subject to the following conditions: Subsections 21.41.077(a) (b) (c) and (e) shall be complied with: per business is permitted other than a ggDirectoryl@ A frame sign.
