PLANNING COMMISSION RESOLUTION NO. 3534
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A GENERAL
PLAN CONSISTENCY DETERMINATION FOR THE
ACQUISITION OF 10 ACRES AND LEASING OF 5 ACRES
OWNED BY SDG&E LOCATED ON THE NORTH SIDE OF
GOVERNMENT PURPOSES INCLUDING A WASTE
PROCESSING AND TRANSFER STATION.
CASE NAME: CITY ACQUISITION OF SDG&E
CASE NO: PCD/GPC 93-02
WHEREAS, a verified application for certain property to wit:
Portion of parcel 5 SBE, Map 141-37-73F,
CANNON ROAD WEST OF 1-5 FOR A RANGE OF POSSIBLE
CANNON ROAD AND 1-5 PROPERTY
has been filed with the City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided b
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 18th day of August, 1993
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony anc
arguments, if any, of all persons desiring to be heard, said Commission considered a1
factors relating to the Planning Commission Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissior
as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing, the CommissioI
APPROVES PCD/GPC 93-02, based on the following findings:

Findinp:
1. Acquisition of the property for public utility purposes including a waste processi~
and transfer station is consistent with Goal G of the General Plan Land U
Element which states, 'Provide for an orderly balance of both public and priva
land uses withjn convenient and compatible locations throughout the City a~
ensure that all such uses - type, amount, design and arrangement - serve to prote
and enhance the environment, character and image of the Ciy.
The propertfs location adjacent to the SDGU Encina Power Plant, hture plannc
industrial development, Interstate 5, and the AT&SF Railway is compatible wi~
the intended use for the site. The property has convenient access to Interstate
to accommodate trucking and is adjacent to the existing rail line in the event tm
is shipped by rail to a future disposal site. Adequate means of waste handling an
disposal are necessary to protect the environment. The property has bee
previously graded and contains no significant environmental resources.
2. The proposed acquisition is consistent with Policy B of the Land Use Elema
which is, "Arrange land uses so that they preserve community identity, and a~
orderly, functionally efficient, heal-, convenient to the public and aestheticall
pleasing".
Cornunity i.dentity will not be significantly changed as the property appears t
be: past of the SDG&E Encina Power Plant. The positive attributes of the propert
are its freeway and rail access which make it functionally efficient for developmer
as a waste processing and transfer station. Perimeter screening exists and il
adequacy for screening development of the property will be reviewed when th
required development plans are .submitted.
3. The Goal of the Public Facilities Element of the General Plan which is, 'To pmvid,
a comprehensive services and public facilities and public building program for th
citizens of the City of carlsbad now and in the future so as to ensure that al
necessary public facilities will be available concurrent with need in connectio~
with the development of the City pursuant to the balance of the Gad Plan
supports the proposed acquisition.
Public facilities are needed to process and dispose of solid waste generated by th.
community. Acquisition of the property allows for additional waste disposz
options hecause of the proximity of the adjacent rail line.
4. Policy C.15 of the Opein Space and Comervation Hement states that "The Cit. shall cooperate with othex jurisdictions to ensure the timely provision cf solic
waste management and sewage disposal capacity".

Acquisition of the property is consistent with this policy as hugh cooperati1
efforts with other jurisdictions the potential of sending the commmitfs sol:
waste by rail to distant landfills has been identified as a possible solution to tl
Citfs waste disposal needs. The site has several attributes which make it appe;
to be ideal for the primary intended use.
5. Development of the property with a waste processing and transfa station or 0th
govemment use is consistent with the existing General Plan designation :
implemented through the Zoning Ordinance. Upon approval of a conditional Us
Permit public buildings and accessory public buildings and quasi-public utili1
buildings and facilities are permitted in all zones. The remainder of the propm
which is designated as Public Utilities (U) is a designation which is consistent wi~
the intended use of the property.
6. The acquisition is also consistent with Policy 1.1 of the Agua Hedionda Land U:
Plan which reads, "Land uses in the Agua Hedionda Plan area shall be consista
with those indicated on the Land Use Map (Exhibit "C')".
The General Plan Land Use Map is consistent with the Land Use Map of the Agu
Hedionda Plan Development of the property with a waste processing and transfc
station or other government use is consistent with the Local Coastal Plan a
implemented through the Zoning Ordinance.
7. Acquisition of the property d not have a significant impact on the environmer;
and a Negative Declaration has been issued by the Planning Director on July 15
1993. In approving this Negative Declaration the Planning Commission ha
considered the initial study, the staff analysis, and any written comments receive
regarding the significant effects &is property acquisition could have on th
environment.
