CASE NAME: VILLAS AT EL CAMINO REAL APPROVAL OF A ZONE CHANGE FROM L-C TO RD-M ON CASE NO: ZC 93-02 WHEREAS, a verified application for certain property, to wit: Parcel 2 of Parcel Map No. 1188, in the County of San Diego, State of California, according to map thereof filed in the Office of County Recorder of San Diego County, December 20,1972. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 o the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 1st day of September, 1993 hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimoq and arguments, if any, of all persons desiring to be heard, said Commission considered a] factors relating to the Zone Change; and I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Codssiol as follows: A) That the foregoing recitations are true and correct. The proposed Zone Change is consistent with all applicable policies and guidelines in the Land Use Element of the General Plan as discussed in the staff report for the project. 2. The proposed change in zoning designation is consistent with the General Plan and will achieve consistency between the General Plan and Zoning as required by State Law and the Land Use Element. 3. All findings of the Conditional Negative Declaration, Resolution No. 3536 are incorporated herein by reference. Conditions: 1. All conditions of the Conditional Negative Declaration, as contained in Resolution No. 3536, and conditions contained in Resolution Nos. 3538, 3539 and 3540, are incorporated herein by reference. Refer to those documents for all conditions and mitigation measures applicable to the development of the project site. 2. Approval of ZC 93-02 is granted subject to the approval of the Conditional Negative Declaration. 3. Approval of ZC 93-02 is granted subject to approval of the tentative parcel map for Minor Subdivision 93-07 by the City Engineer. I.. * ;- , // 0 e l5XHll51-1 ' I/ ORDKNANCE NO. 1 2 3 4 5 6 7 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY AN AMENDMENT TO THE ZONING MAP TO GRANT A ZONE CHANGE, ZC 93-02 FROM L-C TO RD-M ON PROPERTY GENERALLY LOCATED ADJACENT TO AND WEST OF EL CAMINO REAL, SOUTH OF CAMINO VIDA ROBLE, AND NORTH OF ALGA ROAD, IN LOCAL FACILITIES MANAGEMENT ZONE 21. CASE NAME: VILLAS AT EL WINO REAL CASE NO: ZC 93-02 The City Council of the City of Carlsbad, California does ordain as follows: 9 11 SECTION I: That Title 21 of the Carlsbad Municipal Code is amended by 10 11 the amendment of the zoning map as shown on the map marked "Exhibit ZC 93-02", attached hereto and made a part hereof. 12 13 SECTION 11: That the hdings and conditions of the Planning Commission 14 as set forth in Planning Commission Resolution 3537 constitutes the findings and 15 conditions of the City Council. 16 17 18 19 20 21 Council held on the - day of , 1993, and thereafter EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Sun within fifteen days after its adoption.
