CASE NAME: ZONE 11 AND 12 LOCAL FACILITIES MANAGEMENT PLANS CASE NUMBER: LFMP 87-1 1 (A)\LFMP 87-12(A) t5 I1 WHEREAS, pursuant to the Growth Management Program, the City o '7 11 Carlsbad has required the property owners within Local Facilities Management Zones 1: 8 9 10 11 12 11 and 12 are portions of Rancho Santa Fe Road and Olivenhain Road; and 13 WHEREAS, on May 19,1992, the City Council approved a Financing Plan fo l4 Zones 11 and 12 which called for the formation of an Assessment District to finance tht 15 construction of Rancho Santa Fe Road, Olivenhain Road, and other minor infrastructurf 16 and 12 to prepare a Financing Plan for public facilities that are necessary to servl development in those zones; and WHEREAS, the primary public facilities needed to serve development in Zone improvements; and 17 18 WHEREAS, the City in cooperation with the property owners in Zones 11 zn: 19 financing mechanism in place of an ,4ssessment District for these facilities; and 20 1 12 have now determined that a Community Facilities District (CFD) may be the preferrec 21 WHEREAS, the City and the property owners in Zones 11 and 12 wish tl 22 I/ amend the previously adopted Financing Plan to allow use of a CFD, or other simila 23 24 25 26 27 Management Program. programs as the financing mechanism; and WHEREAS, the Planning Commission finds that use of a CFD for the statec facilities meets the crireria for a financial guarantee as required by the Growtl 28 . .- a e NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissiol 1 2 of the City of Carlsbad, California as follows: 3 4 1. That the above recitations are true and correct. 2. That the amendment to the Financing Plans of Zones 11 and 12 Loca 5 11 Facilities Management Plans are hereby approved by the replacement of a1 6 7 8 9 10 11 references to "Assessment District" with references to "Assessment District Community Facilities District, or other financing program acceptable to tht City Council." Any development occurring within the boundaries of Zone: 11 and 12 shall comply with all terms and conditions of said plans.
