A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LAND USE
ELEMENT OF THE GENERAL PLAN WHICH ADDS THE
RESIDENTIAL MEDIUM HIGH DENSITY (RMH) AND
RESIDENTIAL HIGH DENSITY (RH) DESIGNATIONS TO THE
EXISTING COMBINATION DISTRICT FOR PROPERTY
GENERALLY LOCATED NORTH OF THE BATIQUITOS
LOCAL FACILITIES MANAGEMENT PLAN ZONE 9.
CASE NAME: AVIARA PHASE 111
LAGOON, EAST OF 1-5 AND WEST OF EL CAMINO REAL IN
CASE NO: GPA 93-06
9 WHEREAS, a verified application for an amendment to the General Plar
lo designations for certain property located, as shown on Exhibit GPA 93-06, date(
'I I/ November 17, 1993, attached and incorporated herein, has been filed with the Planninl

WHEREAS, the Planning Commission did, on the 17th day of Novembe~ 16
as provided in Title 21 of the Carlsbad Municipal Code; and
1993, and the 1st day of December, 1993, hold a duly noticed public hearing a

WHEREAS, at said public hearing, upon hearing and considering a 20
21 testimony and arguments, if any, of all persons desiring to be heard, said Commissic
22 considered all factors relating to the General Plan Amendment.
23 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic

WHEREAS, said verified application constitutes a request for amendmen
prescribed by law to consider said request;
of the City of Carlsbad, as follows:

B) That based on the evidence presented at the public hearing, the Comissio
recommends APPROVAL of GPA 93-06, based on the following findings an
subject to the following conditions.
Findin~s:
1. The proposed general plan amendment preserves consistency between the Lan
Use element and existing development within the Aviara Master Plan.
Conditions:
1. Approval of GPA 93-06 is granted subject to the approval of MP 177(G), LCPA 9;
01, CT 92-03, and HDP 92-04. GPA 93-06 is approved subject to all conditior
of approval of MP 177(G), LCPA 92-01, CT 92-03, and HDP 92-04, Plannin
Commission Resolutions 3574, 3576, 3577, and 3578, incorporated herein b
reference and on file in the Planning Department.
