HomeMy WebLinkAbout1994-01-05; Planning Commission; Resolution 3608? 0 0 1 2 3 4 5 6 7 PLANNING COMMISSION RESOLUTION NO. 3608 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A CONDOMINIUM PERMIT TO DEVELOP A 184 UNIT MULTIFAMILY RESIDENTIAL DEVELOPMENT ON PROPERTY GENERALLY LOCATED 0.25 MILES WEST OF EL CAMINO REAL AND 0.75 MILES SOUTH OF PALOMAR AIRPORT ROAD IN LOCAL FACILITIES MANAGEMENT ZONE 21. CASE NO: CP 93-02 CASE NAME: POINSETTIA HILL 8 /I WHEREAS, a verified application for certain property to wit: 9 10 7.I The northwest quarter of the southwest quarter of Section 23, Township 12 south, Range 4 west, in the City of Carlsbad, San Diego County. AI has been filed with the City of Carlsbad and referred to the Planning Commission; and 12 13 WHEREAS, said verified application constitutes a request as provided by Title 14 15 hold a duly noticed public hearing as prescribed by law to consider said request; and 16 WHEREAS, the Planning Commission did, on the 5th day of January, 1994: 21 of the Carlsbad Municipal Code; and I.7 I! The granting of this permit will not adversely affect and will be consistent with Title 21, the General Plan, and all applicable adopted plans of the City and otha governmental agencies as demonstrated by the project's consistency with all provisions of these documents. 2. The proposed condominium use at the site location is necessary and desirable to provide a service or facility which will contribute to the long-term general well- being of the neighborhood and the community because the area is designated for medium density residential uses in the General Plan and development is necessary to continue the balance of land uses in the City. a 3- 9 10 11 12 13 14 15 16 17 5. 4. Such condominium use will not be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity since the project meets all required City standards and ordinances and adequate setbacks and buffers fi-om the neighboring community park and industrial uses have been incorporated into the projects design. The proposed planned development meets all of the minimum development standards and design criteria set forth in Sections 21.45.090 and 21.45.080 of the Carlsbad Municipal Code, and has been designed in accordance with the concepts contained in the design guidelines manual as demonstrated by features such as 32 foot wide private streets, adequate guest and recreational vehicle parking, building orientation and massing related to the topography, spacious and accessible common recreation areas, and clustered development away fi-om the preserved open space. The proposed project is designed to be sensitive to and blend in with the natural topography of the site by stepping development down the existing slope and providing a variety of building setbacks and orientations, along the ridgeline. 18 19 20 21 22 23 24 25 6. The proposed project maintains and enhances significant natural resources on the site through the preservation and enhancement of over 11 acres of mixed chaparral habitat. 7. The proposed project's design and density of the developed portion of the site is compatible with surrounding development and does not create a &harmonious or disruptive element to the neighborhood because the proposed townhome products and the medium range density are similar to those neighboring areas such as that found in the Aviara Master Plan and the proposed residential uses have been setback from the adjacent community park and industrial uses. 8. The proposed project's circulation system is designed to be efficient and well integrated with the project and does not dominate the project as demonstrated by 26 27 28 PC RES0 NO. 3608 -2- Ii 0 0 its conformance to all City standards and the development standards of the Planned 1 Development Ordinance and as shown on the site plan exhibits. 2 3 Conditions: 4 1. Approval is granted for CP 93-02, as shown on Exhibits "A" - "NN", dated January 5, 1994, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these 5 conditions. 6 7 8 9 10 2. Approval of CP 93-02 is granted subject to the approval of CT 93-03, SDP 93-02, and HDP 93-02.
