A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE
DEVELOPMENT PERMIT TO DEVELOP 6 SINGLE FAMILY
UNITS ON PROPERTY GENERALLY LOCATED IN THE
NORTHEAST QUADRANT OF THE CITY, EAST OF THE
FUTURE ALIGNMENT OF TAMARACK AVENUE, SOUTHEAST
OF APPROVED VILLAGE "T"-NORTH AND NORTHWEST OF
LAKE CALAVERA WITHIN THE CALAVERA HILLS MASTER
PLAN, IN LOCAL FACILITIES MANAGEMENT PLAN ZONE 7.

WHEREAS, at said public hearing, upon hearing and considering all testimon!

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio~
of the City of Carlsbad as follows:
25 1 A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commissio:
APPROVES HDP 90-31, based on the following findings and subject to th
following conditions:
Findin=:
1. That hillside conditions and undevelopable areas of the project have been proper1
identified consistent with the City's Hillside Development Ordinance (Chapter 21.9
of the Municipal Code). The site's hillside slope conditions and undevelopable ares
have been identified on Exhibits " C" and "D" dated January 19, 1994. In additio~
Exhibit "E" provides cross sections of the proposed hillside development. 1 7 2. That the development proposal and all applicable development approvals an
8 permits are consistent with the purpose, intent, and requirements of Chapter 21 -9.
and that the project design substantially conforms to the intent of the concept

a. All manufactured cut and fill slopes are landform/contour graded and do nc
exceed a height of 30 feet.
b. The project's grading is consistent with the grading concept approved for th
buildout of the Calavera Hills Master Plan. The project's cut/fill gradin
volume of 6,216 cubic yards per graded acre falls within the "acceptabl
range" of 0 - 7,999 cubic yds./acre.
c. Landscaping in conformance with the City's Landscape Manual would bc
provided on all manufactured slopes to assist in visually screening the slope
and to reduce slope erosion.

d. The project meets all the requirements of the Hillside Developmen
Regulations and Guidelines with regards to hillside grading, architecture ant
building locations.
The proposed grading wiU allow compliance with hillside development regulation
on a master plan level. In addition, the proposed fill and grading concept for Villag
"R" will allow development that will be an architectural and physical extension a
Village IT'-North consistent with the intent and regulations of the Calavera Hill
Master Plan. The project's manufactured slopes will be contour graded to maintai
the integrity of the adjacent natural hillside open space areas.

project, ensured building permits will not be issued for the project unless the Citl

Engineer determines that sewer service is available, and building cannot occu
within the project unless sewer service remains available, and the Plannin
Commission is satisfied that the requirements of the Public Facilities Element of th
General Plan have been met insofar as they apply to sewer service for this projec.
5. The applicant is by condition, required to pay any increase in public facility fee, c
new construction tax, or development fees, and has agreed to abide by an
additional requirements established by a Local Facilities Management Plan prepare
pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensur
continued availability of public facilities and will mitigate any cumulative impacl
created by the project.

6. This project is consistent with the City's Growth Management Ordinance as it ha
been conditioned to comply with any requirement approved as part of the Locz
Facilities Management Plan for Zone 7.
7. The applicant has agreed and is required by the inclusion of an appropriat
condition to pay a public facilities fee. Performance of that contract and paymen
of the fee will enable this body to find that public facilities will be availabl
concurrent with need as required by the general plan.
Conditions:
1. All conditions of approval for CT 90-24 as contained in Planning Commissio
Resolution No. 3612 are applicable to this approval and incorporated through thi
reference.
2. Approval for HDP 90-31, as shown on Exhibits "A'--"O", dated January 19, 1994 i
incorporated by reference and on file in the Planning Department. Developmen
shall occur substantially as shown on the approved exhibits.
3. Approval of HDP 90-31 is granted subject to approval of CT 90-24, and PUD 90-24
