HomeMy WebLinkAbout1994-02-02; Planning Commission; Resolution 3599., d I/ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 3599 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN WHICH DELETES OFFICE USE AND INTRODUCES AN OPEN SPACE DESIGNATION, CHANGES A COMMUNITY COMMERCJAL DESIGNATION TO EXTENSIVE REGIONAL RETAIL, AND DEFINES HIGH, AND EXTENSIVE REGIONAL RETAIL DESIGNATIONS ON PROPERTY GENERALLY LOCATED SOUTH OF LA COSTA AVENUE, EAST AND NORTH OF THE CITY OF ENCINITAS, AND WEST OF EL CAMINO REAL IN LOCAL FACILITIES MANAGEMENT ZONE 23. CASE NAME: GREEN VALLEY MASTER PLAN THE BOUNDARIES OF THE OPEN SPACE, RESIDENTIAL MEDIUM- CASE NO: GPA 93-01 WHEREAS, a verified application for an amendment to the General Pla designation for certain property located, as shown on Exhibit GPA 93-01, dated Januar 19, 1994, attached and incorporated herein, has been filed with the Pi& Commission; and WHEREAS, said verified application constitutes a request for amendmer to the General Plan as provided in Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 19th day of January, 199 and on the 2nd day of February, 1994, hold a duly noticed public hearing as prescribe by law to consider said request; WHEREAS, at said public hearing, upon hearing and considering a testimony and arguments, if any, of all persons desiring to be heard, said Commissic considered all factors relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio of the City of Carlsbad, as follows: A> That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissio recommends APPROVAL of GPA 93-01, based on the following findings: 0 0 1 2 3 4 5 6 7 FilldinES: 1. Goal "A" of the General Plan Land Use Element encourages the preservation and enhancement of the environment, character, and image of the City as a desirable residential, beach and open space oriented community. The project sustains a visual quality of open space. 2. Goal "I?' of the General Plan Land Use Element suggests protecting and coflservinz natural resources, fi-agile ecological areas, unique ~tUI-al assets and historidJ significant features of the community. Within the 166.5 acres of Open Space the fi-agile, unique natural assets and historically significant fames of the communit~ have been preserved. 8 3. 9 10 11 12 13 14 4. Goal l.A.2 of the Open Space Element requests preservation and creation of ax Open Space system of aesthetic value that will maintain community identity: achieve a sense of natural spaciousness, and provide visual relief in the Cityscape The provision of open space over the minim- Growth Management Plar requirement achieves this feeling of natural spaciousness and provides fo~ significant visual relief to both the residents and commercial users of the Masta Plan, and the users of the public facilities. Goal 2.A.l of the Open Space Element desires the exploration of all means oj providing for Open Space needs. The Master Plan Amendment is increashg tht Open Space by over 40 acres. 15 16 17 18 5. Goal 2.A.2 of the Open Space Element is to assure that new development provide! for the Open Space needs of their occupants. The Master Plan includes passivc and active Open Space that exceeds the 15% standard required by the Loca Fadties Management Plan and the Planned Community Ordinance Approximately 70% of the Master Plan is a combination of natural and revegetatei Open Space. 19 1 6. Goal 3A2 of the Open Space F.lement is to protect and preserve visually attractiw and/or significant natural areas. In general with this plan, such linkages are not required because oj the connectivity of the Open Space. 10. The proposed Open Space area is equal to or greater than the area depicted on tht Open Space and Conservation Map since the Map shows approximately 95 acre while the General Plan Amendment identifies approximately 166 acres. 5 6 11. The proposed Open Space area is of environmental quality equal to or greater tha~ that depicted on the Open Space and Conservation Map as indicated by a review of the Environmental Impact Report for the Green Valley Master Plan, data 7 December 1993. 8 12. The proposed Open Space is in conformance with the proposed City of Carlsbac 10 9 Habitat Management Plan and the Countywide Master Habitat Conservation Plan. 13. The proposed adjustment to Open Space, as depicted on the Open Space and conservation Map, is contiguous or within close proximity to Open Space as Amendment Graphic. 11 shown on the Open Space Map as confirmed by a review of the General Plan 12 14. The provision of a regional related commercial center is supported by a markel 13 14 survey dated Januasy 11,1993, and verified and documented by a report dated December 14,1993. The proposed amendment will generally reduce the projected traffic burden or adjacent roadways by approximately 15%. 16. All conditions of EIR 93-02 and MP 92-01 as contained in Planning Commission Resolution Nos. 3598 and 3600 respectively, are incorporated herein by reference. Refer to those documents for all conditions and mitigation measures applicable to the development of the Green Valley Master Plan project site. 2. Approval of GPA 93-01 is granted subject to the certification of EIR 93-02 and approval of MP 92-01. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning 8 9 Commission of the City of Carlsbad, California, held on the 2nd day of February, 1994, 10 /I by the following vote, to wit: 11 12 13 14 AYES: Chairperson Savary, Commissioners: Schlehuber, Betz, Nobk & Hall.
