CASE NAME: GREEN VALLEY MASTER PLAN CASE NO: MP 92-01 WHEREAS, a verified application for the Green Valley Master Plan fol certain property to wit: A portion of Section 2, Township 13 South, Range 4 West; and a portion of Section 35, Township 12 South, Range 4 West, San Bernardino Meridian, City of Carlsbad, County of San Diego, State of California. has been filed with the City of Carlsbad and referred to the Planning Commission; and 14 ll WHEREAS, said verified application constitutes a request for a Master Plar 15 and on the 2nd day of February, 1994, hold a duly noticed public hearing as prescribe( 1'7 WHEREAS, the Planning Commission did, on the 19th day of January, 199d 16 as provided in Title 21 of the Carlsbad Municipal Code; and l8 (( by law to consider said request; 19 I 20 WHEREAS, at said public hearing, upon hearing and considering al. 21 22 considered all factors relating to the Master Plan. 23 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissior 24 of the City of Carlsbad, as follows: 25 A) That the above recitations are true and correct. 26 27 recommends APPROVAL of MP 92-01, based on the following findings. 28 testimony and arguments, if any, of all persons desiring to be heard, said Commissior B) That based on the evidence presented at the public hearing, the CommissioI ..I 0 1 2 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 FiIldillES: 1. The proposed development as described by the Master Plan is consistent with the provisions of the General Plan as ident3ied within the findings for GPA 93-01 Resolution No. 3599 and all findings of said resolution are incorporated herein by reference. 2. All necessary public facilities can be provided conment with need and adequatt provisions have been provided to implement those portions of the capita improvement program applicable to the subject property. The Master Plan ha! language in the text stating that all future development shall comply with tht public facility performance standards and phasing requirements of the Loca Facilities Management Plan (LFMP) for Zone 23. Public facilities are required tc be constructed as development in the Master Plan creates demand for additiona facilities. A financing plan approved by the City Council for the Zone 23 LFMI: will provide the mechanism for the financing of the required public facilities. 3. The residential and open space portions of the Master Plan will constitute ar enviroment of sustained desirability and stability, and that it will be in harmon] with or provide compatible variety to the character of the surrounding area, an( that the sites proposed for public facilities, such as streets and flood contro structures are adequate to serve the anticipated population. 4. The Open Space plan provides 166.5 acres of open space within the Master Plat which is to be used for the protection of biological habitat, the migration o wildlife, trails for hikers and bicyclists, recreation, visual aesthetics, and buffm from developed areas. 5. Commercial development is proposed for this site in keeping with the Guideline of the Land Use Element of the General Plan. 6. The streets and thoroughfares proposed are suitable and adequate to cany tht anticipated trafhc thereon. Traffic studies have been completed for the Loca Facilities Management Plan 87-23 and EIR 93-02. Compliance with the mitigati01 conditions required by these studies and plans would ensure that all circulatiol infrastructure is in place to serve the traffic demands generated by buildout of tht Master Plaa 22 7. All conditions of EIR 93-02, GPA 93-01, LFMP 87-23, and CT 92-08 as containec in Planning Commission Resolutions Nos. 3598, 3599, 3602, and 360: respectively, are incorporated herein by reference. Refer to those documents fo all conditions and mitigation measures applicable to development of the Greel Valley Master Plan. 5 11 2. "Prior to the approval of any final map or the issuance of any permit within the Green Valley Master Plan, the applicant for the final map 01 permit shall submit evidence to the City that impacts to school facilitie have been mitigated in conformance with the City's Growth Managemen Plan to the extent permitted by applicable state law. If the mitigatiox involves a financing scheme such as a Mdo-Roos Fadties District whicl is inconsistent with the Citfs Growth Management Plan including Cornu Policy Statement No. 38, the developer shall submit disclosure document for approval by the City Manager and City Attorney which shall disclose tc future owners in the project, to the maximum extent possible, the existem of the tax and that the school district is the taxing agency responsible fo the financing district." b. Actual yield will depend on subsequent specific approva of a Site Development Plan, Precise Development Plan, and/or a Plannec Unit Development by the City Council. c. AU Planning areas are subject to and shall comply with public facilitie requirements included in Local Facilities Management Plan for Zone 23. d. Maintenance of the open space planning areas and all detention, ddtatio1 and depollutant facilities shall be the responsibility of all property owner within the boundaries of the Green Valley Master Plan. Maintenam responsibility may be assigned in part or completely to an other entiq subject to the approval of the City of Carlsbad. e. Due to the scope of the Master Plan and the consistently changing needs oj the community, the Extensive Regional Retail designation within the Masta Plan shall be reviewed by the Planning commission for reconsideration 24 months from the effective date by City Council or 12 months from thf effective approval date by the California Coastal commission whicheva should occur hrst. Site Development Plan (SDP) - A SDP is required for the development oi unsubdivided residential units within Planning Area 3. Site Developmen1 Plans are reviewed and approved by the Planning Commission. 3. Errata as found on Green Valley Master Plan Errata dated January 19,1994 shall be incorporated into the final edition of the Green Valley Master Plan. 4. A fifth Planning Area shall be included in the Master Plan with a boundaq description as shown on attachment Planning Area 5. The Planning Area shall bt known as Planning Area 5 and shall have a land use designation of Unplanned Uses within Planning Area 5 shall be limited to the continued use of the red ban and those uses found in Planning Area 1 of the same Green Valley Master Plan Text and exhibits for Planning Area 5 consistent with and throughout thc remaining Master Plan shall be prepared and approved by the Planning Directo~ prior to submittal of the Master Plan to the California Coastal Commission for : Coastal Development Permit. At such time that the intersection area of El Camin( Real and La Costa is planned out the current property owner may request a changt in land use designation for Planning Area 5 subject to the approval of a precisc development plan. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planninl Commission of the City of Carlsbad, California, held on the 2nd day of February, 1994 by the following vote, to wit: AYES: Chairperson Savary, Commissioners: Schlehuber, Betz, Noblc & Hall.
