HomeMy WebLinkAbout1994-02-02; Planning Commission; Resolution 3601(I) 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 3601 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE CARLSBAD LOCAL COASTAL PROGRAM TO AMEND THE LAND USE OF THE GREEN VALLEY PORTION OF THE EAST BATIQUITOS IAGOON/HUNT PROPERTIES SEGMENT OF THE LOCAL, COASTAL PROGRAM CASE NAME: GREEN VALLEY MASTER PLAN CASE NO: LCPA 93-06 WHEREAS, California State law requires that the Local Coastal Program General Plan, and Zoning designations for properties in the Coastal Zone be ir conformance; and WHEREAS, the Planning Commission did on the 19th day of January, 199L and on the 2nd day of February, 1994, hold a duly noticed public hearing as prescribe( by law to consider the proposed suggested modifications to the East Batiquito! LagoodHunt Properties segment of the City's Local Coastal Program as shown on Exhibi LCPA 93-06, and; WHEREAS, at said public hearing, upon hearing and considering al testimony and arguments, if any, or all persons desiring to be heard, said Commissior considered all factors relating to the Local Coastal Program Amendment. WHEREAS, State Coastal Guidelines require a six week public review perioc prior to final action for any amendment to the Local Coastal Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning CommissioI of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State mandated six week review period, starting 01 December 9, 1993, and ending on January 20, 1994, staff shall present tc the City Council a summary of the comments received. ... 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 C) That based on the evidence presented at the public hearing, the Commissio recommends APPROVAL of LCPA 93-06 as shown on Exhibit LCPA 93-0( dated January 19, 1994, attached hereto and made a part hereof based c the following findings and subject to the following conditions: Findinns: 1. The proposed Local Coastal Program Amendment is consistent with all applicab policies of the East Batiquitos LagoodHunt Properties segment of the LOC Coastal Program. 2. The proposed Local Coastal Program Amendment maintains consistency with th legislative findings and declarations of the California Coastal Act, as stated i Section 30001 of Division 20 of the Public Resources Code. Conditions: 1. Approval of LCPA 93-06 is subject to the approval of GPA 93-01 and MP 92-0: Planning Commission Resolution NO’S. 3599 and 3600 incorporated herein E reference and on file in the Planning Department. 2. Approval of LCPA 93-06 is subject to approval of the California Coast; Commission. hy revisions that may be required by the Coastal Commission mu be reviewed and approved by the Planning Director and City Engineer prior t approval of any final map, and may necessitate a formal amendment to thi approval. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Plannin Commission of the City of Carlsbad, held on the 2nd day of February, 1994, by th following vote, to wit: AYES: Chairperson Savary?
