A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A SPECIAL, USE PERMIT
TO DEVELOP A 600,000 SF COMMERCIAL CENTER AND 400 UNIT
LOCATED SOUTH OF LA COSTA AVENUE AND WEST OF EL
WINO REAL ENCOMPASSING ALMOST THE ENTIRETY OF
MULTI-FAMILY HOUSING PROJECT ON PROPERTY GENERALLY
LOCAL FACILITIES MANAGEMENT PLAN ZONE 23, APN NOS. 216-
122-24, 36, 37; 255-011-08 THROUGH 12 AND 255-021-05

CASE NAME: GREEN VALLEY MASTER PLAN
CASE NO: SUP 92-05
WHEREAS, a verified application for certain property, to wit:
Those portions of Section 35, Township 12 South, Range 4 West,
and Section 2, Township 13 South, Range 4 West, San Bernardino
Meridian, in the City of Carlsbad, County of San Diego, State of
California, according to official plat thereof, said property being
more particularly described in Exhibit "A" of quitclaim deed recorded
March 28, 1989, as File No. 89-157040 of official records of said
San Diego County.
has been filed with the City of Carlsbad, and referred to the Planning Commission; and
WHEREAS, said application constitutes a request as provided by Title 21 ol
the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 19th day of January, 1994
and on the 2nd day of February, 1994, hold a duly noticed public hearing as prescribed
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said Commission
considered all factors relating to the Special Use Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commission
APPROVES SUP 92-05, based on the following findings and subject to the
following conditions:
Findin=:
1. The proposed project does not create a hazard for future development or proposed
future structures.
2. The proposed project is designed to be protected from flood damage so that no
increase in flood related hazards will be created.
3. The extent of the flooding hazards involved with this project have been sufficiently
identified to meet the requirements of FEMA and the City's Flood Plain
Management Ordinance.
4. With the Conditions of Approval, the proposed project shall not create a hazard
or cause adverse impacts for adjacent or upstream properties.
5. With the Conditions of Approval, the proposed project shall not create a hazard
or adverse impacts to downstream properties.
6. With the Conditions of Approval, the proposed project shall not reduce the abiliq
of the site to pass or manage a base flood of 100-year frequency.
Conditions:
1. Approval of SUP 92-05 is subject to the approval of conditions of CT 92-08.
