A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING A NEGATIVE DECLARATION
FOR A PLANNING COMMISSION DETERMINATION OF GENERAL
PLAN CONSISTENCY TO EXTEND AVENIDA ENCINAS BETWEEN
THE ENCINA WASTE WATER TREATMENT PLANT AND THE NORTH
COUNTY TRANSIT DISTRICT RAIL STATION PROPERTY.

WHEREAS, the Planning Commission did on the 2nd day of February, 199
hold a duly noticed public hearing as prescribed by law to consider said request, and
WHEREAS, at said public hearing, upon hearing and considering all testimor
and arguments, examining the initial study, analyzing the information submitted by staj
and considering any written comments received, the Planning Commission considered 2
factors relating to the Negative Declaration.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissic
as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Plannir
Commission hereby recommends APPROVAL of the Negative Declaratic

NEGATIVE DECLAEWTION
PROJECT ADDRESS/LOCATION: Avenida Encinas south of Palomar Airport Road and
north of Poinsertia Lane.
PROJECT DESCRIPTION: tmprovement of Avenida Encinas' from Palomar Airport Road
to approximately .75 miles north of Poinsettia Lane which
include curb, gutter and sidewalk.
The City of Carlsbad has conducted an environmental review of the above described project
pursuant to the Guidelines for Implementation of the California Environmental Quality Act
and the Environmental Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not have a significant
impact on the environment) is hereby issued for the subject project. Justification for this
action is on file in the Planning Department.
A copy of the Negarive Declaration wirh supportive documents is on file in the Planning
Department, 2075 Las Palmas- Drive, Carlsbad, California 92009, Comments from the
public are invited. Please submit comments in writing to the Planning Department within
30 days of date of issuance. If you have any questions,. please call Christer Westman in the
Planning Department ,at (6 19) 438- 1 161, extension 4448. .

D[SCUSStON OF ENVIRONMENTAL EVALUATlON
The road widening and extension: project will nor have adverse effects on the land through which it pas:
The topography is generally flat so there. is no need for extensive grading or earth movement. The land I
been previously disturbed through agriculture and vehicular movement and has been kept free of plar
native and exotic.
The Biological Resources Report prepared for the project did identify disturbance of .04 acres of artific
wetland near the southern limit of the project. The wetland is not part of a natural system and is rheref
not considered to be significant. Disturbance to this area will not require mitigation. '
Curb, gutter and sidewalk is proposed along the length of the project. These improvements along w
drainage inlets/outlets will control run-off: The control of run-off minimizes indirect impacts which may ocl
as a result of the project on adjoining lands.
As recommended by 'the Biological Resources Report, a condition to clearly mark vernal pool habitat
adjacent property will be required. The condition will reduce the potential for inadvertent direct impact
the habitat which is not within the area of work.
