HomeMy WebLinkAbout1994-03-02; Planning Commission; Resolution 3629t !i e 0 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 PLANNING COMMISSION RESOLUTION NO. 3629 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE AMENDMENT OF A PLANNED UNIT DEVELOPMENT TO REDUCE A TWO STORY BUILDING TO A SINGLE STORY, REMOVE PARKING SPACES AND INCREASE THE MAXIMUM CAPACITY OF STUDENTS AND PLAY AREA FOR A DAYCARE ON PROPERTY GENERALLY LOCATED SOUTH OF HOSP WAY AND EAST OF EL CAMINO REAL. CASE NAME: WESTERN FINANCIAL PLAZA CASE NO: PUD 90-021A) WHEREAS, a verified application for certain property to wit: Parcel 2 of Parcel Map 8586 in the City of Carlsbad in the County of San Diego, State of California, filed in the office of the County Recorder of San Diego County, being a division of portions of lots 4 and 5 in Section 32, Township 11 South, range 4 West, San Bernardino Meridian, according to official plat thereof. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Titl 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 2nd day of March, 199~ hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimon and arguments, if any, of all persons desiring to be heard, said Commission considered a factors relating to the Planned Unit Development. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissic recommends APPROVAL of PUD 90-02(A), based on the following findings an subject to the following conditions: 28 \ I\ e 0 Findings: -. l. 2 21.45 of the Carlsbad Municipal Code and the Carlsbad General Plan; 3 1. The granting of this permit will not adversely affect and is consistent with Chaptt 2. The existing and proposed uses will provide services which will contribute to th 4 long term general well-being of the neighborhood and the community; 5 6 3. The existing and proposed uses will not be detrimental to the health, safety ( 7 8 general welfare of persons working or residing in the vicinity; 4. The existing and proposed development meets or exceeds the development standard set forth in Section 21.45.090 of the Carlsbad Municipal code; 5. The existing and proposed development meets or exceeds all of the design criteri 9 set forth in Section 21.45.080 of the Carlsbad Municipal Code and has bee lo ll designed in accordance with the concepts contained in the design guidelines manua 11 12 13 14 15 16 6. The existing and proposed development blends to a great degree with the existin topography; 7. The site does not contain any significant natural resources; 8. The existing and proposed development is compatible with surrounding developmer and does not create a disharmonious or disruptive element to the neighborhood; 9. The proposed development will not diminish the quality of the existing circulatiol system which is well integrated and does not dominate the project. 17 1 conditions: 18 19 1.
