PLANNING COMMISSION RESOLUTION NO. 3635
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CONDITIONAL USE PERMIT ALLOWING THE CONTINUED OPERATION
OF A CHURCH, DAY CARE CENTER, AND SUNDAY SCHOOL ON A 3.54
ACRE PROPERTY LOCATED AT 7807 CENTELLA STREET.
CASE NAME: CHRIST UNITED PRESBYTERIAN CHURCH
CASE NO: CUP 229x2
WHEREAS, a verified application has been filed with the City of Carlsbad anc
CARLSBAD, CALIFORNIA, APPROVING A TEN-YEAR EXTENSION OF A
referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request as provided by Title 2:
of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Plannin;
Commission did, on the 2nd day of March, 1994, hold a duly noticed public hearing tc
consider said application on property described as:
That portion of Lot 249 of La Costa Vale Unit 1, Map 7547 and Lot 181
and 182 of Santa Fe Glens Map No. 8059
WHEREAS, at said public hearing, upon hearing and considering all testimony an
arguments, if any, of all persons desiring to be heard, said Commission considered a
factors relating to CUP 229x2.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of th
City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissio
APPROVES a five year extension for CUP 229x2, based on the following finding
and subject to the following conditions:
Findinns:
1. That the requested use is necessary or desirable for the development of th
community, is essentially in harmony with the various elements and objectives (
the general plan, and is not detrimental to existing uses or to uses specificall
permitted in the zone in which the proposed use is to be located. The church an
day care center provides a valuable support service for the surrounding residentk

neighborhoods. Staff has visited the site and no complaints concerning the churc
land use have been received over the past 10 years.
2. That the site has proved to be adequate in size and shape to accommodate the us
The church site plan is still only partially completed, however, there is adequal
onsite parking to accommodate the church and day care uses.
3. That all of the yards, setbacks, walls, fences, landscaping, and other featurc
necessary to adjust the proposed church to existing or permitted future uses in tl
neighborhood will be provided and maintained. Fencing is provided along tl
southern and western property lines to separate the site from the residenti
property and heavy landscaping, including tree and shrubs, are provided alor
Rancho Santa Fee Road, to visually screen the site from the public right-of-wa
The project’s landscaping is in a healthy and thriving state.
4. That the street system serving the proposed use is adequate to properly handle z
traffic generated by the proposed use because Centella Street is adequate in si;
to handle the traffic generated by the proposed use.
5. The environmental impacts of this project have already been considered during tl
original approval of CUP 229, resulting in the issuance of a Negative Declaratic
dated May 5,1983. Continued operation of the church and day care would nl
result in any additional significant adverse environmental impacts.
Conditions:
1. All conditions of approval imposed upon CUP 229 and CUP 229x1 as stated :
Planning Commission Resolution No. 2127 except Condition No. 10, and Planni~
Commission Resolution No. 2949, except Condition Nos. 24, shall apply i
conditions of approval for CUP 229x2.
2. This conditional use permit is extended for a period of ten (10) years from JUI
8, 1993, and will expire on June 8, 2003 unless subsequent extensions a:
approved. This conditional use permit shall be reviewed by the Planning Directc
on a yearly basis to determine if all conditions of this permit have been met ar
that the use does not have a significant detrimental impact on surroundir
properties or the public health and welfare. If the Planning Director determinc
that the use has such significant adverse impacts, the Planning Director slx
recommend that the Planning Commission, after providing the permittee tl
opportunity to be heard, add additional conditions to mitigate the significal
adverse impacts. This permit may be revoked at any time after a public hearin
if it is found that the use has a significant detrimental affect on surrounding lar
uses and the public’s health and welfare, or the conditions imposed herein hay
not been met. This permit may be extended for a reasonable period of time nc
to exceed ten (10) years upon written application.
