PLANNING COMMISSION RESOLUTION NO. 3631
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF THE GENERAL PLAN AMENDMENT
UPDATING ALL ELEMENTS TO THE CITY OF CARLSBAD
GENERAL PLAN
CASE NAME: GENERAL PLAN UPDATE
CASE NO: GPA 94-01
WHEREAS, a verified application for an amendment to the General Plan h
been filed with the Planning Commission; and
WHEREAS, said verified application constitutes a request for amendme]
as provided in Title 21 of the Carlsbad Municipal Code; and
WHEREAS, Government Code Section 65358 provides that when it
deemed to be in the public interest, the legislative body may amend all or part of a
adopted General Plan; and
WHEREAS, Government Code Section 65358(b) states that no mandatol
element of a General Plan shall be amended more frequently than 4 times during ar
calendar year. However, each amendment may include more than 1 change to tl
General Plan. Appropriately in conjunction with General Plan Amendment 94-01, c
which all elements are being amended, that said action shall be considered as on
amendment per Section 65358(b); and
WHEREAS, in accordance with Government Code Section 65353, th
Planning Commission did, on the 16th day of March, 1994, the 6th day of April, 199
and the 20th day of April, 1994 hold a duly noticed public hearing as prescribed by la1
to consider said request;
WHEREAS, at said public hearing, upon hearing and considering a

testimony and arguments, if any, of all persons desiring to be heard, said Commissio
considered all factors relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio
of the City of Carlsbad, as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissio
recommends APPROVAL of GPA 94-01, amending all Elements of th
Carlsbad General Plan, including resultant textual and map change
identified as Errata to the General Plan, which are hereby incorporate
herein by reference. Said textual and map changes will be made in th
printing of the Final document. This recommendation is based on th
following findings and conditions:
Findinns:
1. That General Plan Amendment 94-01 has been reviewed in accordance with th
California Environmental Quality Act and Final Environmental Impact Report (E1
93-01), which adequately addresses the general environmental setting of tE
proposed project, its significant environmental impacts and the project alternativf
and mitigation measures related to each significant environmental effect for th
proposed project has been reviewed and considered by the Planning Commissio:
and it is determined that any remaining significant effects on the environmer
found to be unavoidable have been balanced against the benefits of the project an
against the project alternatives and those benefits have been found to b
overriding on each significant impact identified in the EIR.
2. That General Plan Amendment 94-01 is in the best interest of the public based o
the following:
a. The comprehensive update of the General Plan ensures that the Cit
conforms to changes in State law, reflects current court decisions an
provides an integrated and internally consistent set of goals and policic
designed to reflect the changing characteristics and growth of th
community.
b. The updated General Plan will direct future growth and development in th
City of Carlsbad.

C. The updated General Plan reflects community input on goals and objectiv
through the public participation process.
d. The updated goals, policies and implementation programs will ensure th
the City of Carlsbad has a legally adequate General Plan which is bo
consistent with State law and reflects the "vision" of its citizens.
Conditions:
1. Revisions to the Gad Plan Update, GP 94-01 shall be made, as necessary,
ensure that all documents are consistent with approved changes to MEIR 93-0
PASSED, APPROVED, AND ADOPTED at a regular meeting of the PlanniI
Commission of the City of Carlsbad, California, held on the 20th day of April, 1994, 1
the following vote, to wit:
AYES: Chairperson Savary, Commissioners: Schlehuber, Nobl
Welshons, Erwin & Hall.
NOES: None.
ABSENT: Commissioner Betz.
ABSTAIN: None.
