HomeMy WebLinkAbout1994-04-20; Planning Commission; Resolution 3641m e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 1 20 21 22 23 24 25 I PLANNING COMMISSION RESOLUTION NO. 364-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A PRECISE PLAN AMENDMENT TO REMODEL AND EXPAND THE EXISTING NCTD BUS TRANSIT CENTER AT PLAZA CAMINO REAL ON PROPERTY GENERALLY LOCATED ALONG THE NORTH SIDE OF MARRON ROAD. CASE NAME: PLAZA CAMINO REAL BUS TURNOUT CASE NO: PP 24(F) WHEREAS, a verified application has been filed with the City of Carlsbad an referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Tit1 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Plannin Commission did, on the 20th day of April, 1994, consider said request on propert described as: Portion of Sections 31 and 32, T.115, R.4W., San Bernardino Base Meridian, County of San Diego. WHEREAS, at said public hearing, upon hearing and considering all testimon and arguments, if any, of all persons desiring to be heard, said Commission considered a factors relating to PP 24(F). NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissia af the City of Carlsbad as follows: ~ A) That the foregoing recitations are true and correct. The project is consistent with precise Plan 24, in that it will improve the appearancl and overall operation of the NCID transit facility at Plaza Camino ReaL 2. The project complies with all applicable City parking and driveway design standarch 3. The project will improve on-site circulation and ensure the maintenance of adequat onsite parking at Plaza Camino Real. 4. The project is consistent with the General Plan since the improvements to the NCll bus turnout will improve transit access for all communities to Plaza Camino Real 5. The proposed project is compatible with the surrounding future land uses sinc surrounding properties are designated for Intensive Regional Retail or Open Spac development on the General Plan. 6. This project will not cause any significant environmental impacts and a Negativ Declaration has been issued by the Planning Director on December 9, 1993 an recommended for approval by the Planning Commission on April 20, 1994. I: approving this Negative Declaration the Planning Commission has considered th initial study, the staff analysis, all required mitigation measures and any writte: comments received regarding the significant effects this project could have on th environment. 7. This project is consistent with the Citfs Growth Management Ordinance as it ha been conditioned to comply with any requirement approved as part of the Lac; Facilities Management Plan for Zone 1. P1anni.n~ Conditions: 1. Approval is granted for PP 24(F), as shown on Exhibit(s) "A" - H", dated Apd 2C 1994, incorporated by reference and on file in the Planning Departrneni Development shall occur substantially as shown unless otherwise noted in lthes conditions. 2. The developer shall provide the City with a reproducible 24" x 36", mylar copy c the Site Plan as approved by the Planning Commission. The Site Plan shall reflec the conditions of approval by the City. The plan copy shall be submitted to the Cit Engineer prior to issuance of right-of-way permit. .... This project shall comply with all conditions and mitigation required by the Zonl 1 Local Facilities Management Plan approved by the City Council on September 1 1987, incorporated herein and on file in the Planning Department and any futur~ amendments to the Plan made prior to the issuance of right-of-way permit. 4. If any condition for construction of any public improvements or facilities, or th payment of any fees in lieu thereof, imposed by this approval or imposed by law 0: this project are challenged this approval shall be suspended as provided i Government Code Section 65913.5. If any such condition is determined to b invalid this approval shall be invalid unless the City Council determines that th project without the condition complies with all requirements of law. 5. Approval of this request shall not excuse compliance with all sections of the Zonin, Ordinance and all other applicable City ordinances in effect at time of right-of-wa permit issuance. 10 6. An exterior lighting plan including parking areas shall be submitted for Plannin, Director approval. All lighting shall be designed to reflect downward and avoid an I1 impacts on adjacent homes or property. 12 13 7. The applicant shall prepare a detailed landscape and irrigation plan which shall b submitted to and approved by the Planning Director prior to the issuance of right4 way permit. 14 15 from weeds, trash, and debris. 8. Landscape plans shall be designed to minimize water use. Lawn and other zone plants (see Landscape Manual) shall be limited to areas of special visual importanc or high use. Mulches shall be used and irrigation equipment and design sha promote water conservation. 12. The developer shall avoid trees that have invasive root systems, produce excessiv litter and/or are too large relative to the lot size. 24 13. Planter width shall be a minimum of four (4) feet, not including curb, footing 25 26 27 and/or other paving, and parking overhang. Prior to final occupancy, a letter from a California licensed landscape architect shd be submitted to the Planning Director certifying that all landscaping has bee] installed as shown on the approved landscape plans. 15. AU herbicides shall be applied by applicators licensed by the State of California. 16. The applicant shall pay a landscape plan check and inspection fee as required b: Section 20.08.050 of the Carlsbad Municipal Code. 17. The minimum shrub size shall be 5 gallons. 18. Any signs proposed for this development shall at a minimum be designed i~ conformance with the City's Sign Ordinance and shall require review and approva of the Planning Director prior to installation of such signs. 19. As part of the plans submitted for landscape plan check, the applicant shall includr a reduced legible version of the approving resolution/resolutions on a 24" x 36 blueline drawing. 20. This project is approved subject to the condition that no commercial advertkiq shall be allowed on bus shelters, information signage or concrete seat walls. En&~eerinz Conditions: 21. Unless a standards variance has been issued, no variance from City Standards i! authorized by virtue of approval of this site plan. 22. The applicant shall comply with all the rules, regulations and design requirement: of the respective sewer and water agencies regarding services to the project. 23. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bel Telephone, and Cable TV authorities. 24. Prior to building permit issuance the applicant shall pay all current fees and deposit: required. 25. Plans, specifications, and supporting documents for all (PUBLIC) improvements shall be prepared to the satisfaction of the City Engineer prior to issuance of a right-of. way permit. The applicant shall install improvements as shown on the site plan All improvements will be done under the purview of a right-of-way permit. The applicant shall install wheelchair ramps at the public street corners abutting the project site in conformance with City of Carlsbad Standards prior to the issuance of a building permit. 27. The structural section for the access aisles must be designed with a traffic index of 5.0 in accordance with City Standards due to bus access. The structural pavement design of the aisle ways shall be submitted together with required R-value soil tesi information and approved by the City as part of the building site plan review. communitv services: 7 8 9 10 11 the following vote, to wit: 28.
