CASE NAME: SHORELINE PRESERVATION CASE NO: LCPA 93-05 WHEREAS, California State law requires that the Local Coastal Program General Plan, and Zoning designations for properties in the Coastal Zone be i~ conformance; and STRATEGY OBJECTIVES WHEREAS, a verified application for an amendment to Local Coasta Program text for all segments, as shown in Exhibit ??X!', dated May 4, 1994, attached anc incorporated herein, has been filed with the Planning Commission; and WHEREAS, said verified application constitutes a request for amendmen as provided in Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 4th day of May, 1994, holc a duly noticed public hearing as prescribed by law to consider the proposed suggestec modifications to the text of all segments of the Local Coastal Program shown on Exhibi "X", dated May 4, 1994, attached hereto, and; WHEREAS, at said public hearing, upon hearing and considering al testimony and arguments, if any, of all persons desiring to be heard, said CommissioI considered all factors relating to the Local Coastal Plan Amendment. WHEREAS, State Coastal Guidelines require a six week public review perioc for any amendment to the Local Coastal Program. \ e 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissio of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State mandated six week review period, starting o January 7, 1994, and ending on February 22, 1994, staff shall present t the City Council a summary of the comments received. C) That based on the evidence presented at the public hearing, th Commission recommends APPROVAL of LCPA 93-05, as shown on Exhibj "X", dated May 4, 1994, attached hereto and made a part hereof based 0: the following findings: Findinns: 1. The proposed Local Coastal Program Amendment is consistent with the goals c the Womia Coastal Act because it will facilitate the permanent protection of tb state's ~t~ral and scenic resources and preclude the deterioration and destrudo of the sandy areas in the coastal zone. 2. The proposed Local Coastal Program Amendment is consistent with the goals c the Mdo I, Mdo II, Agua Hedionda Lagoon, West Batiquitos Lagoon, Ea! STANDARD PACIFIC Policy 3 - Drainage, Erosion Control A site specific report prepared by a qualified professional shall be required to provide the necessary mitigation for increased runoff and sedimentation. The report shall be subject to the requirements of the Model Erosion Control Ordinance contained in the Appendix to the June 1980 Carlsbad Master Drainage Plan and the additional requirements contained herein. Such mitigation shall become an element of the project and shall be installed prior to initial grading. At a minimum, such mitigation shall require construction of all improvements shown in the Master Drainage Plan between the project site and the lagoon (including the debris basin), restriction of grading activities to the months of April through September, revegetation of all graded areas immediately after grading, and mechanism for permanent maintenance if the City declines to accept the responsibility. Construction of drainage improvements may be through the formation of an assessment district of through any similar arrangement that allots .costs among the various landowners in an equitable manner. 3. OCCIDENTAL LAND, INC. Policy 2 - Drainage, Erosion Control In the event of commercial and/or residential development pursuant to a Coastal Development Permit, a site specific report prepared by a qualified professional shall be required to provide the necessary mitigation for increased runoff and sedimentation. The 3 VrLLAGE REDEVELOPMENT AREA 11. OBJECTIVES OF THE DESIGN MANUAL, The implementation of the Village Redevelopment Plan and the comprehensive improvement of the urban core of the Carlsbad planning area are the primary objectives of the Design Manual. The intent of the Village Design manual is to provide general design guidelines and regulations. The document should provide an understanding of the "type" and "qualitf' of development being sought by the Housing and Redevelopment Commission (Redevelopment Agency). It should be viewed as providing guidance and parameters rather than strict standards. The primary responsibility for applying and interpreting the guidelines contained herein rests with the Design Review Board and with the Commission which retains ultimate authority and responsibility for application. The Design Review Board shall consist of highly qualified persons with an interest in the field of urban design and a member fYom the City staff shall be appointed to advise associated proposals as they relate to the Village Design Manual and intent of this plan. 5
