PLANNING COMMISSION RESOLUTION NO. 3646
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE
DEVELOPMENT PERMIT ON PROPERTY GENERALLY
LOCATED SOUTH OF HAYMAR DRlVE AND EAST OF EL
CAMIN0 REAL.
CASE NAME: CARLSBAD GOLF PRACTICE FACILITY
CASE NO: HDP 93-15
WHEREAS, a verified application for certain property to wit:
That portion of Government Lot 2, in Section 32, Township
11 South, Range 4 West, San Bernardino Meridian, in the
City of Carlsbad, County of San Diego, State of California,
according to the United States Government Survey approved
December 27, 1870,
has been filed with the City of Carlsbad and referred to the Planning Commissj
WHEREAS, said verified application constitutes a request as pro
Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 4th day of Mti
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testirr
arguments, if any, of all persons desiring to be heard, said Commission consic
factors relating to the Hillside Development Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Con
as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Con
APPROVES HDP 93-15, based on the following findings and subjecl
following conditions:

FhdillES:
1. That hillside conditions have been properly identified and the project sit
more than one slope within the area of disturbance greater than 40%;
2. That the single slope greater than 40% is 10 feet high by 45 feet wide
created by previously authorized grading;
3. That undevelopable areas of the project site have been properly identific
4. That the project has been designed to be coflsistent with the intent and
of the Hillside Development Regulations;
5. That grading quantities are below the maximum allowed at 2,188 cubic J
acre.
6. That hillside grading is not proposed within any area that has been ider

7. That the project design and lot configuration minimizes the necessary dis

4, Prior to the issuance of the HDP 93-15 there shall be a Notice of Restrictio
on the Notice to this property subject to the satisfaction of the Planning
notifying all interested parties and successors in interest that the City of (
has issued a Conditional Use Permit by Resolution No. 3645 on the real :
owned by the declarant. Said Notice of Restriction shall note the
description, location of the file containing complete project details
