The granting of this permit will not adversely affect and will be consistent 21, the General Plan, and all applicable adopted plans of the City i govemmental agencies as demonstrated by the project's consistency provisions of these documents. 2. The proposed planned unit development use at the site location is still nect desirable to provide a service or facility which will contribute to the general well-being of the neighborhood and the community because tl designated for low to medium density residential uses in the General Pla Aviara Master Plan and development is necessary to continue the balan uses in the City. 3. The proposed planned unit development is minor in nature because it t change the densities or boundaries of the property, add or rearrange uses w site, or change the approved yards, coverage, height, open space, or lan more than ten percent. Conditions: 1. Approval is granted for PUP 105(A), as shown on Exhibits "A" - "O", datec 1994, incorporated by reference and on file in the Planning Dep; Development shall occur substantially as shown unless otherwise noted conditions. 2. The developer shall provide the City with a reproducible 24" x 36", mylar the site plan as approved by the Planning Commission. The site plan sha the conditions of approval by the City. The plan copy shall be submitted to Engineer and approved prior to building, grading, final map, or improvemc submittal, whichever occurs first. 3. This project is approved upon the express condition that building permits be issued for development of the subject property unless the District E determines that sewer facilities are available at the time of application i sewer permits and will continue to be available until time of occupancy. 4. This project is also approved under the express condition that the applicant public facilities fee adopted by the City Council on July 28, 1987 (amendec 1991) and as amended from time to time, and any development fees establj the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code ( ordinance adopted to implement a growth management system or facilit improvement plan and to fulfill the subdivider's agreement to pay the facilities fee, a copy of which is on file with the City Clerk and is incorpor this reference. If the fees are not paid this application will not be consiste the General Plan and approval for this project will be void. 5. The applicant shall provide school fees to mitigate conditions of overcrow part of building permit application. These fees shall be based on the fee s' in effect at the time of building permit application. All or a portion of said fc be waived subject to approval of the Carlsbad Unified School District. 6. This project shall comply with all conditions and mitigation measures whi be required as part of the Zone 19 Local Facilities Management Plan a amendments made to that Plan prior to the issuance of building permits. Approval of this request shall not excuse compliance with all sections of tl Ordinance and all other applicable City ordinances in effect at time ol permit issuance. 8. This approval shall become null and void if building permits are not issue project within one year from the date of project approval. 9. All landscaped areas shall be maintained in a healthy and thriving con& from weeds, trash, and debris. 10. The developer shall install street trees at the equivalent of 40-foot interv all public street frontages in conformance with City of Carlsbad standa: trees shall be of a variety selected from the approved Street Tree List. 11.
