A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALlFORNIA, APPROVING A MINOR
PLANNED DEVELOPMENT PERMIT AMENDMENT TO REVISE
BUILDING LOCATIONS AND ARCHITECTURE ON PROPERTY
GENERALLY LOCATED NORTHWEST OF THE INTERSECTION
OF AVIARA DRIVE AND BATIQUITOS LANE IN LOCAL
FACILITIES MANAGEMENT ZONE 19.

WHEREAS, a verified application for certain property to wit:
Parcels 1 thru 48 of Parcel Map No. 16541, in the City of

Filldin-:
1. The granting of this permit will not adversely affect and will be consistent

its conformance to all City standards and the development standards of the
Development Ordinance and as shown on the site plan exhibits.
9. The proposed planned unit development is minor in nature because it t
change the densities or boundaries of the property, add or rearrange uses w
site, or change the approved yards, coverage, height, open space, or lan
more than ten percent.
Conditions:
1. Approval is granted for PUP 105(A), as shown on Exhibits "A" - "O", datec
1994, incorporated by reference and on file in the Planning Dep;
Development shall occur substantially as shown unless otherwise noted
conditions.
2. The developer shall provide the City with a reproducible 24" x 36", mylar
the site plan as approved by the Planning Commission. The site plan sha
the conditions of approval by the City. The plan copy shall be submitted to
Engineer and approved prior to building, grading, final map, or improvemc
submittal, whichever occurs first.
3. This project is approved upon the express condition that building permits
be issued for development of the subject property unless the District E
determines that sewer facilities are available at the time of application i
sewer permits and will continue to be available until time of occupancy.
4. This project is also approved under the express condition that the applicant
public facilities fee adopted by the City Council on July 28, 1987 (amendec
1991) and as amended from time to time, and any development fees establj
the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code (
ordinance adopted to implement a growth management system or facilit
improvement plan and to fulfill the subdivider's agreement to pay the
facilities fee, a copy of which is on file with the City Clerk and is incorpor
this reference. If the fees are not paid this application will not be consiste
the General Plan and approval for this project will be void.
5. The applicant shall provide school fees to mitigate conditions of overcrow

in effect at the time of building permit application. All or a portion of said fc

6. This project shall comply with all conditions and mitigation measures whi

7. Approval of this request shall not excuse compliance with all sections of tl

permit issuance.
8. This approval shall become null and void if building permits are not issue
