CASE NAME: SEAPOINTE RESORT CASE NO: CT 93-10 WHEREAS, a verified application for certain property to wit: Lots 1 and 2 in fractional Section 20, Township 12 south, Range 4 west, San Bernardino base and meridian, in the City of Carlsbad, in the County of San Diego, State of California, according to the official plat thereof; has been filed with the City of Carlsbad and referred to the Planning Commissio WHEREAS, said verified application constitutes a request for a two map for condominium purposes as provided by Title 20 of the Carlsbad Municip, and WHEREAS, the Planning Commission did, on the 17th day of Augus hold a duly noticed public hearing as prescribed by law to consider said request; WHEREAS, at said public hearing, upon hearing and considering all te and arguments, if any, of all persons desiring to be heard, said Commission consic factors relating to the Tentative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Con as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Con recommends APPROVAL of the two lot Tract Map for condominium purpc 93-10, based on the following findings and subject to the following condi .... .. *. .. The two lot tract map for condominium purposes is consistent with the Plan, Local Coastal Program, and Title 21 and that all approvals and required by Title 21 shall be granted concurrently with subdivision apprc 2. The Planning Commission has, by inclusion of an appropriate conditio1 project, ensured building permits will not be issued for the project ur District Engineer determines that sewer service is available, and buildinl occur within the project unless sewer service remains available, and the 1 Commission is satisfied that the requirements of the Public Facilities Eleme General Plan have been met insofar as they apply to sewer service for this 3. School fees will be paid to ensure the availability of school facilities in the ( School District. 4. All necessary public improvements have been provided or will be req conditions of approval. 5. The applicant has agreed and is required by the inclusion of an app condition to pay a public facilities fee. Performance of that contract and I of the fee will enable this body to find that public facilities will be a concurrent with need as required by the General Plan. 6. As designed, the proposed project is compatible with the surrounding futl uses. 7. This project will not cause any significant environmental impacts and a amended Negative Declaration has been issued by the Planning Director on 10, 1994 and is recommended for approval by the Planning Commission on 17, 1994. In recommending approval of this second amended Negative Decl the Planning Commission has considered the initial study, the staff ana! required mitigation measures and any written comments received regard significant effects this project could have on the environment and detedr the second amended Negative Declaration was prepared in accordance v California Environmental Quality Act and Title 19, Environmental Prc Procedures of the Carlsbad Municipal Code. 8. The applicant is by condition, required to pay any increase in public faciliq new construction tax, or development fees, and has agreed to abide additional requirements established by a Local Facilities Management Plan PI pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will continued availability of public facilities and will mitigate any cumulative j created by the project. 9. This project is consistent with the City's Growth Management Ordinance a been conditioned to comply with any requirement approved as part of th Facilities Management Plan for Zone 22. The subdivision has been designed to take advantage of prevailing onsho: throughout westerly orientation which in turn provides for natural opportunities. 11. The approval of the subdivision will not effect the housing needs of the COI because it is for commercial purposes and will therefore not detract f availability of public services or available fiscal or environmental resourct Conditions: Planning: I. Approval is granted for a two lot tract map for condo purposes, CT 93-10,; on Exhibit(s) "A" - "E", dated August 17, 1994, incorporated by reference ar in the Planning Department. Development shall occur substantially as shon otherwise noted in these conditions. 2. The developer shall provide the City with a reproducible 24" x 36", mylar the map as approved by the City Council. The map shall reflect the cond: approval by the City. The map copy shall be submitted to the City Engir approved prior to building, grading, final map, or improvement plan su whichever occurs first. 3. This project is approved upon the express condition that building permits be issued for development of the subject property unless the District E determines that sewer facilities are available at the time of application 1 sewer permits and will continue to be available until time of occupancy. No grading shall occur outside the limits of the subdivision unless a grading easement is obtained from the owners of the affected properties. Prior to hauling dirt or construction materials to or from any proposed cons site within this project, the applicant shall submit to and receive approval f City Engineer for the proposed haul route.
