CASE NAME: DAVIS RESIDENCE RELOCATION CASE NO: PCD 94-02 WHEREAS, a verified application has been filed with the City of Carlsbad an referred to the Planning Commission; and WHEREAS, said verified application constitutes a request to move a structurc as provided by Chapter 18.24 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Plannin; Commission did, on the 7th day of September, 1994, hold a hearing to consider saic application on property described as: Parcel 1 of Map No 151 72, in the City of Carlsbad, County of San Diego, State of California; WHEREAS, at said hearing, upon hearing and considering all testimony an( arguments, if any, said Commission considered all factors relating to PCD 92-05. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commissior: of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission APPROVE5 the application to move a structure (PCD 94-82), based on the following findings and subject to the following conditions: FinhS: 1. The proposed house relocation is consistent with the General Plan as it proposes tc locate a single family home on a residentially designated parcel. 2. The proposed house relocation is consistent with the applicable portions of thc Carlsbad Municipal Code since the relocation request is being heard by the Planning 8 e * 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Commission and the relocated house would meet all requirements of the underlyin; R-1 zone. 3. Since the project involves placement of a single family residence and garage in a urbanized area, it is exempt from environmental review per Section 15303(a) of tf State California Environmental Quality Act Guidelines. Conditions: 1. Approval is granted for PCD 94-02, as shown on Exhibits "A" - "E", dated Septembc 7, 1994, incorporated by reference and on file in the Planning Departmen Development shall occur substantially as shown unless otherwise noted in the: conditions. 2. Approval of this request shall not excuse compliance with all sections of the Zonir Ordinance and all other applicable City ordinances in effect at time of buildir permit issuance. 3. Since a garage is required for all single family residences, no Certificate ( Occupancy or final inspection that would allow occupancy shall be issued for tt relocated house prior to the issuance of a final inspection for the garage structur .... ...o .... . . .. .... .... .... .... .... .... .... .... ....
