CASENAME GEMOLOGICALINSTITUTE OFAMERICA CASE NO: SDP 94-06 SITE DEVELOPMENT PLAN NO. SDP 94-06 FOR THE WHEREAS, a verified application has been filed with the City of Carlsb: and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Tit 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Plannil Commission did, on the 7th day of December, 1994, consider said request on proper described as: Lots 5 and 6 of Carlsbad Tract No. 92-07 (Carlsbad Ranch Unit 1 and Unit 2), in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 13078, filed in the Office of the County Recorder of San Diego County on December 28, 1993. WHEREAS, at said public hearing, upon hearing and considering all testimo: and arguments, if any, of all persons desiring to be heard, said Commission considered i factors relating to SDP 94-06. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commissic APPROVES Site Development Plan, SDP 94-06, based on the followil findings and subject to the following conditions: I1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 Findings: 1. Based on the "Initial Study" prepared for this project the Planning Commissic determines that tlhe project is within the scope of the Carlsbad Ranch Specific Pla Program Environmental Impact Report (EIR 91-3), on file in the Plannir Department, and there are no additional significant adverse environmental impac associated with th.e project, therefore, no further environmental review of this proje is required. 2. That the requested use is properly related to the site, surroundings a1 environmental settings, is consistent with the various elements and objectives of tl general plan, will not be detrimental to existing uses or to uses specifically permittt in the area in which the proposed use is to be located, and will not adversely impa the site, surroundings or traffic circulation as the project design complies with tl requirements of the Carlsbad Ranch Specific Plan and all other requiremen applicable to the site, significant building setbacks and landscape areas have bec incorporated into the project design as well as the provision of outdoor recreation areas. The requested use is consistent with the general plan including Policy C.: of the Industrial Section of the Land Use Element which requires new industri development to be located in modern, attractive, well-designed and landscapc industrial parks in which each site adequately provides for internal traffic, parkin loading, storage, and other operational needs. 3. That the site for the intended use is adequate in size and shape to accommodate tl use as all requirements of the Carlsbad Ranch Specific Plan and the City's %nil Code have been complied with. The project design demonstrates the adequacy the site's size and shape for the intended use as it proposes 768 parking spaces whi only 760 are required, 16 percent of the parking area will be landscaped in contra to the Zoning Ordinance and Specific Plan requirement of 3 percent, 33 percent the site will be landscaped, and building coverage is proposed at 18 percent of tl site. 4. That all yards, setbacks, walls, fences, landscaping, and other features necessary adjust the requested use to existing or permitted future uses in the neighborhood w be provided and maintained. Berming and landscaping are proposed to provil screening for the shipping and receiving area in addition to adequate circulatic area for vehicles maneuvering in that area. At the closest point the building setback 84 feet six inches from Armada Drive (front yard setback) and 60 feet fro the western property line. The minimum landscape setback along Armada Drive proposed at 40 feet and expands to 85 feet at its greatest width. 5. That the street systems serving the proposed use is adequate to properly handle i traffic generatedl by the proposed use with the required circulation syste improvements identified with the approval of the Carlsbad Ranch Specific Plan. T Certified Progralm Environmental Impact Report (EIR) for the Carlsbad Ran' Specific Plan identifies the required improvements which will be constructed as pa of the Tentative ]Map (CT 92-7) and Final Map for Units I and I1 of the Carlsb: PC RES0 NO. 3725 -2- I 0 0 1 Ranch. The EIR assumed the use would generate 2,600 Average Daily Trips (AD1 and the proposed project has been calculated to generate 2,305 ADT. 2 6. The building does not contain more than three levels as shown on the projec 3 exhibits. 4 5 6 7 7. All required setbacks have been increased at a ratio of one horizontal foot for eve1 one foot of vertical construction beyond thirty-five feet and the additional setbac area will be maintained as landscaped open space. 8. The buildings conform to the requirements of Section 18.04.170 of the Carlsba Municipal Code. 8 9. The Airport Landl Use Commission staff and the Airport Manager have found tl Palomar Airport subject to a condition of approval for notification of potential noi! 9 10 project to be consistent with the Comprehensive Land Use Plan for McClellal impacts. ’’ 10. The project complies with the development standards and design guidelines of tl 12 Carlsbad Ranch !Specific Plan (SP 207). 13 14 15 16 11. The Planning Commission has, by inclusion of an appropriate condition to th project, ensured building permits will not be issued for the project unless the Distri Engineer determines that sewer sewice is available, and building cannot occur with the project unless sewer service remains available, and the Planning Commission satisfied that the requirements of the Public Facilities Element of the General PL have been met insofar as they apply to sewer service for this project. 1 7 18 12. The applicant is ‘by condition, required to pay any increase in public facility fee, new construction tax, or development fees, and has agreed to abide by any additior requirements established by a Local Facilities Management Plan prepared pursua to Chapter 21.90 of the Carlsbad Municipal Code. This project is consistent with the City's Growth Management Ordinance as it hi been conditioned to comply with any requirement approved as part of the Lot, Facilities Management Plan for Zone 13. 5 7 6 18. The project is consistent with the City's landscape policies as it has been conditione 8 1. This project is aplproved upon the express condition that building permits will not 1 16 issued for development of the subject property unless the District Enginel determines that sewer facilities are available at the time of application for such sew1 17 permits and will continue to be available until time of occupancy. 18 19 20 21 22 23 4. This project is also approved under the express condition that the applicant pay tl public facilities fee adopted by the City Council on July 28, 1987 (amended July 1991) and as amended from time to time, and any development fees established 1 the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or 0th ordinance adopted to implement a growth management system or facilities a1 improvement plan and to fulfill the subdivider's agreement to pay the public faciliti fee dated June 117, 1994, a copy of which is on file with the City Clerk and incorporated by this reference. If the fees are not paid this application will not 1 consistent with the General Plan and approval for this project will be void. 24 25 5. The applicant is aware that the City is preparing a non-residential housing impa fee (linkage fee) consistent with Program 4.1 of the Housing Element. The applical is further aware that the City may determine that certain non-residential projec may have to pay a linkage fee, in order to be found consistent with the Housil Element of the General Plan. If a linkage fee is established by City Count ordinance and/or resolution and this project becomes subject to a linkage f: pursuant to said resolution, then the applicant for this project, or his/her/the successor(s) in interest shall pay the linkage fee. The linkage fee shall be paid the time of issuance of building permits, except for projects involving a request f; a non-residential planned unit development for an existing development, in whit case, the fee shalll be paid on approval of the final map, parcel map or certificate compliance, required to process the non-residential PUD, whichever pertains. linkage fees are required for this project, and they are not paid, this project will n be consistent witlh the General Plan and approval for this project will become nt and void. 9. If any condition for construction of any public improvements or facilities, or tl payment of any fees in lieu thereof, imposed by this approval or imposed by law c this project are challenged this approval shall be suspended as provided Government Code Section 65913.5. If any such condition is determined to be inva,' this approval shad be invalid unless the City Council determines that the projt without the condition complies with all requirements of law. 10. Approval of this 'request shall not excuse compliance with all sections of the Zoni Ordinance and all other applicable City ordinances in effect at time of buildi permit issuance. 11. This approval shdl become null and void if building permits are not issued for tl project within two years from the date of project approval. 12. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gal pursuant to City standards. Location of said receptacles shall be approved by t Planning Director. Enclosure shall be of similar colors and/or materials to t project to the satisfaction of the Planning Director. 13. All roof appurtenances, including air conditioners, shall be architecturally integrat and concealed from view and the sound buffered from adjacent properties a streets, in substame as provided in Building Department Policy No. 80-6, to t satisfaction of the Directors of Planning and Building. 14. An exterior lighting plan including parking areas shall be submitted for Plannj Director approval. All lighting shall be designed to reflect downward and avoid a impacts on adjacent homes or property. The applicant shall pay a landscape plan check and inspection fee as required Section 20.08.050 of the Carlsbad Municipal Code. The first set of landscape and irrigation plans submitted shall include building p1a1 improvement plans and grading plans. All signs proposed for this development shall at a minimum be designed conformance with the City's Sign ordinance and the Carlsbad Ranch Specific P1 and shall require review and approval of the Planning Director prior to installati of such signs. A uniform sign ]program for this development shall be submitted to the Planni Director for his review and approval prior to occupancy of any building. Building identification and/or addresses shall be placed on all new and existi buildings so as to be plainly visible from the street or access road; color identification and/or addresses shall contrast to their background color. As part of the plans submitted for building permit plan check, the applicant sh include a reduced version of the approving resolution/resolutions on a 24" x : blueline drawing. Said blueline drawing(s) shall also include a copy of any applical Coastal Development Permit and signed approved site plan. Prior to the iss;uance of a building permit, the project applicant shall obt: approval of a Coastal Development Permit from the California Coastal Commissi that approves development that is in substantial conformance with the City appro\ A copy of the signed permit issued by the California Coastal Commission shall submitted to the Planning Department. A recycling program shall be implemented for the proposed project which wi include white paper, newspaper, glass, plastic and metal recyclables. Prior to tt issuance of building permits the building plans shall demonstrate that an area ( adequate size andl screened from public view will be provided for the collection ( recyclables. Refer to Engineering Standard GS - 16, Refuse Bin Enclosure. 28. Prior to the issuance of building permits the owner of record of the subject proper shall prepare and record a notice that this property is subject to overflight, sigh and sound of aircraft operating from Palomar Airport in a manner meeting tl approval of the Planning Director and the City Attorney. 29. The project shall be constructed as a single phase unless phasing is approved by tl Planning Director and City Engineer. If phasing is approved, all building permi in reliance on this Site Development Plan must be issued within 5 years of the da on which this approval was granted. Engineering: 30. Unless a standards variance has been issued, no variance from City Standards authorized by virtue of approval of this site plan. 31. The applicant shall comply with all the rules, regulations and design requirements 1 the respective sewer and water agencies regarding services to the project. 32. The applicant shall be responsible for coordination with SDG&E, Pacific Bc Telephone, and Cable TV authorities. 33. Prior to grading or building permit issuance, the applicant shall pay all current fe and deposits required. 34. Prior to approval of the grading or building permit, the owner of the subject propel shall execute an agreement holding the City harmless regarding drainage across t: adjacent property. 35. Pretreatment of the sanitary sewer discharge from this project may be required. addition to the :requirements for a sewer connection permit the applicant sh, conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall exercise special care during the construction phase of this proje to prevent offkite siltation. Planting and erosion control shall be provided accordance with the Carlsbad Municipal Code and the City Engineer. Referenc Chapter 11.06. 37. Prior to hauling dirt or construction materials to or from any proposed constructic site within this project, the applicant shall submit to and receive approval from tl City Engineer fo:r the proposed haul route. The applicant shall comply with i conditions and requirements the City Engineer may impose with regards to tl hauling operation. 9 38. Additional drainage easements may be required. Drainage structures shall 1 provided or installed prior to or concurrent with any grading or building permit 10 may be required by the City Engineer. 11 39. The applicant shall comply with the City's requirements of the National Polluta 12 Discharge Elimination System (NPDES) permit. The applicant shall provide bc management practices to reduce surface pollutants to an acceptable level prior 13 discharge to sensitive areas. Prior to issuing a building permit, all right-of-way permits to construct the pub1 improvements needed for this project shall be issued. The public improvemen needed shall be to the satisfaction of the City Engineer and shall include Cannc Road from Car Country Drive to the intersection of Armada Drive, Armada Dri to the project, a:long the project frontage of Armada Drive and all the drivew approaches to thle project site. The public improvements shall be those projc needed portions of improvements shown on Drawing 333-2 or shown on approv drawings that supersede Drawing 333-2. Prior to occupancy of any building in t' project, the above: public improvements shall be constructed to the satisfaction oft City Engineer. 41. Prior to issuing a building permit a consolidation of Lots 5 and 6 of CT 92-07 sh; be recorded. The! application for an adjustment plat to do the consolidation may made prior to or concurrently with the application for a building permit. 42. Prior to issuing a building permit the applicant shall submit proof that an existi SDG&E easement lying on the site has been quitclaimed to the satisfaction SDG&E. 26 43. Prior to issuing a building permit, a Construction Change to Drawing 333-2 27 Grading Permit l?E 2.93.07, which indicates the grading needed for this project sh be done to the satisfaction of the City Engineer. 28 .... Prior to issuing a building permit, the owner shall make an offer of dedication ( additional right-of-way needed for a free right turn lane into the northerly drivewa from Armada Dfive. The dedication shall be from the northerly project boundal to the southerly line of the northerly driveway and shall be 11 feet wide or as ma be determined by the City Engineer. All property so offered for dedication shall E free and clear of liens and encumbrances. 45. Prior to issuing a building permit the applicant shall pay the difference between tt drainage area fee paid with CT 92-07 and the fee due under the current Mastc Drainage Plan per City Council Resolution No. 04-260 adopted September 13,1991 46. In accordance with the requirements of the Zone 13 LFMP, the site is subject 1 paying a pro-rata share of the cost of construction of Cannon Road. Prior to issuir a building permit, the applicant shall pay the fee or assessment established by tl City for the financing of Cannon Road Reaches I and 11. Prior to the issuance of building permits, complete building plans shall be submittt to and approved 'by the Fire Department. 49. Additional on-site public water mains and fire hydrants are required. 50. Applicant shall submit a site plan to the Fire Department for approval, which depic location of required, proposed and existing public water mains and fire hydranl The plan should :include off-site fire hydrants within 200 feet of the project. 51. Applicant shall submit a site plan depicting emergency access routes, driveways a] traffic circulation for Fire Department approval. 52. An all weather, unobstructed access road suitable for emergency service vehicles shi be provided and maintained during construction. When in the opinion of the Fi Chief, the access road has become unserviceable due to inclement weather or 0th reasons, he may, :in the interest of public safety, require that construction operatio cease until the condition is corrected. I 53. All required fire Ihydrants, water mains and appurtenances shall be operational pri to combustible building materials being located on the project site. Plans and/or specifications for fire alarm systems, fire hydrants, extinguishing system! automatic sprinklers, and other systems pertinent to the project shall be submitte to the Fire Department for approval prior to construction. 55. An approved automatic fire sprinkler system shall be installed in buildings having a aggregate floor area exceeding 10,000 square feet. 56. A monument sign shall be installed at the entrance to the driveway or private strec indicating the add.resses of the buildings on site. Carlsbad Municipal Water District: 57. The entire potable and non-potable water systemhystems for subject project shall k evaluated in detail to ensure that adequate capacity and pressure for domesti landscaping and fire flow demands are met. 58. The developer shiall be responsible for all fees, deposits and charges which will 1: collected before and/or at the time of issuance of the building permit. The Sa Diego County Water Authority capacity charge will be collected at issuance 4 application for meter installation. 59. Sequentially, the developer's engineer shall do the following: A. Meet with the City Fire Marshal and establish the fire protectic requirements. Also obtain G.P.M. demand for domestic and irrigation' needs from appropriate parties. B. Prepare a (colored reclaimed water use area map and submit to the PlanniI Department for processing and approval. C. Prior to the preparation of sewer, water and reclaimed water improveme1 plans, a meeting must be scheduled with the District Engineer for revie! comment ;and approval of the preliminary system layouts and usages (ie GPM - EIIU). 60. This project is approved upon the expressed condition that building permits will n' be issued for development of the subject property unless the water district serving tl development determines that adequate water service and sewer facilities are availab at the time of application for such water service and sewer permits will continue be available until time of occupancy. 61. Water and sewer service will be available when Carlsbad Ranch Unit # improvement pla~ns are completed and completely operational and accepted by tl District.
