A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, APPROVING
A SPECIAL USE PERMIT TO ALLOW THE
CONSTRUCTION OF A 121,000 SQUARE FOOT
DISTRIBUTION CENTER ON PROPERTY LOCATED
WITHIN THE EL CAMINO REAL SCENIC CORRIDOR
AT 5936 PRIESTLY DRIVE IN THE CARLSBAD
RESEARCH CENTER.

WHEREAS, a verified application for certain property, to wit:
Lot 12, of Carlsbad Tract No. 81-10, in the City of Carlsbad,
County of San Diego, State of California, according to Map
thereof No. 10330, filed in the office of the County Recorder of
San Diego County, February 18, 1982.
has been filed with the City of Carlsbad, and referred to the Planning Commission; and
WHEREAS, said application constitutes a request as provided by Title 21 t
the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 7th day of December, 199'
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimo~
and arguments, if any, of all persons desiring to be heard, said Commission considered 2
factors relating to the Special Use Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissic

3. This project is approved upon the express condition that building permits will not b
issued for development of the subject property unless the District Enginec
determines that sewer facilities are available at the time of application for such sewt
permits and will continue to be available until time of occupancy.
4. This project is also approved under the express condition that the applicant pay th
public facilities fee adopted by the City Council on July 28, 1987 (amended July :
1991) and as amended from time to time, and any development fees established t:
the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or otht
ordinance adopted to implement a growth management system of facilities an
improvement plan and to fulfill the subdivider’s agreement to pay the public facilitir
fee dated August 11, 1994, a copy of which is on file with the City Clerk and
incorporated by this reference. If the fees are not paid this application will not t:
consistent with the General Plan and approval for this project will be void.

incorporated herein and on file in the Planning Department and any futur
amendments to the Plan made prior to the issuance of building permits.
6. If any condition for construction of any public improvements or facilities, or th
payment of any fees in lieu thereof, imposed by this approval or imposed by law o
this project are challenged this approval shall be suspended as provided i
Government Code Section 66020. If any such condition is determined to be invali
this approval shall be invalid unless the City Council determines that the projec
without the condition complies with all requirements of law.
7. Approval of this request shall not excuse compliance with all sections of the Zonin
Ordinance and all other applicable City ordinances in effect at time of buildin
permit issuance.
8. This approval shall become null and void if building permits are not issued for th
project within one year from the date of project approval.
9. The project shall comply with the latest non-residential disabled access requiremen
pursuant to Title 24 of the State Building Code.
10. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gat6
pursuant to City standards. Location of said receptacles shall be approved by th
Planning Director. Enclosure shall be of similar colors and/or materials to th
project to the satisfaction of the Planning Director. All trash receptacle areas sha
be consistent with California State recycling requirements.
11. All roof appurtenances, including air conditioners, shall be architecturally integrate
and concealed from view and the sound buffered from adjacent properties an
streets, in substance as provided in Building Department Policy No. 80-6, to th
satisfaction of the Directors of Planning and Building.
12. All lighting shall be designed to reflect downward and avoid any impacts on adjacel
properties.
13. No outdoor storage of material shall occur onsite unless required by the Fire Chie

14. The applicant shall prepare a detailed landscape and irrigation plan which shall 1

15. All landscape and irrigation plans shall be prepared to conform with the Guidelines
Landscape Manual and submitted per the landscape plan check procedures on file
in the Planning Department.
16. The applicant shall pay a landscape plan check and inspection fee as required by
Section 20.08.050 of the Carlsbad Municipal Code.
17. The first submittal set of landscape and irrigation plans submitted shall include
building plans, improvement plans and grading plans.
18. Any signs proposed for this development shall at a minimum be designed in
conformance with the El Camino Real Development Standards, the City’s Sig
Ordinance, and the Carlsbad Research Center Specific Plan sign program and shal:
require review and approval of the Planning Director prior to installation of suc€
signs.
19. Building identification and/or addresses shall be placed on all new and existin<
buildings so as to be plainly visible from the street or access road; color a
identification and/or addresses shall contrast to their background color.
20. The project shall attempt to develop a ride to work and home program for it
employees with the North County Transit District. Furthermore, the project shal
attempt to limit the staggering of worker shifts so as to facilitate the success of sail
program.
21. The applicant is aware that the City is preparing a non-residential housing impact fe
(linkage fee) consistent with Program 4.1 of the Housing Element. The applicant i
further aware that the City may determine that certain non-residential projects ma
have to pay a linkage fee, in order to be found consistent with the Housing Elemen
of the General Plan. If a linkage fee is established by City Council ordinance and/a
resolution and this project becomes subject to a linkage fee pursuant to sail
ordinance and/or resolution, then the applicant for this project, or his/her/thej
successor(s) in interest shall pay the linkage fee. The linkage fee shall be paid at th
time of issuance of building permits, except for projects involving a request for a no]
residential planned development for an existing development, in which case, the fe
shall be paid on approval of the final map, parcel map or certificate of compliana
required to process the non-residential PUD, whichever pertains. If linkage fees a1
required for this project, and they are not paid, this project will not be consistel
with the General Plan and approval for this project will become null and void.
22. The onsite parking of any type of semi-tractor truck or delivery truck shall I
prohibited within the landscaped and/or parking areas adjacent to El Camino Re;
or in the southern perimeter parking area adjacent to the Mission West project.
23. In accordance with Exhibits “MI and “N”, the loading dock areas shall be sufficient
screened so they are not visible from the El Camino Real scenic corridor.

24. Unless a standards variance has been issued, no variance from City Standards i! 2

25. The applicant shall comply with all the rules, regulations and design requirements o
the respective sewer and water agencies regarding services to the project.
26. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bel
Telephone, and Cable TV authorities.
27. Prior to issuance of a building permit for any buildable lot within the subdivision, th(
property owner shall pay a one-time special development tax in accordance with Cit
Council Resolution No. 91-39.
28. Prior to grading permit issuance, the applicant shall pay all current fees and deposit
required.
29. Pretreatment of the sanitary sewer discharge from this project may be required. E
addition to the requirements for a sewer connection permit the applicant shal
conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. Th
applicant shall apply for an industrial waste water discharge permit concurrently wit
the building permit for this project.

15 30. Prior to the issuance of a grading permit or building permit, whichever occurs firs1
the developer shall submit proof that a Notice of Intention has been submitted to th
16 State Water Resources Control Board.
1 7 31. Based upon a review of the proposed grading and the grading quantities shown o
18 the site plan, a grading permit for this project is required. Prior to issuance of
building permit for a project, a grading permit shall be obtained and grading wor
19 be completed is substantial conformance with the approved grading plans.

32. No grading for private improvements shall occur outside the limits of the projec
unless an agreement to grade is executed by the applicant and the owners of th
affected properties. If the applicant is unable to obtain this agreement to grade, n
grading permit will be issued. In that case the applicant must either amend th
Special Use Permit or modify the plans so grading will not occur outside the projec
site in a manner which substantially conforms to the approved site plan 2
determined by the City Engineer and Planning Director.
25 33. Prior to hauling dirt or construction materials to or from any proposed constructia
site within this project, the applicant shall submit to and receive approval from th

conditions and requirements the City Engineer may impose with regards to tE
City Engineer for the proposed haul route. The applicant shall comply with a
27 hauling operation.

34. The developer shall exercise special care during the construction phase of this projec
to prevent offsite siltation. Planting and erosion control shall be provided i
accordance with the Carlsbad Municipal Code and the City Engineer. Referenc
Chapter 11.06.
35. The applicant shall comply with the City’s requirements of the National Polluta
Discharge Elimination System (NPDES) permit. The applicant shall provide be,
management practices to reduce surface pollutants to an acceptable level prior 1
discharge to sensitive areas. Plans for such improvements shall be approved by tE
City Engineer prior to issuance of grading permit. These plans shall incorporate tE
following:
Construction of two onsite depollutant basins as indicated on the project Site Pla
and Grading Plan.
36. Prior to building permit issuance, the applicant shall install a perforated landscal
drain behind the westerly sidewalk along El Camino Real, from Faraday Avenue 1
the southerly property line of the adjacent property to the south of the project sit
in accordance with Exhibit “M”, Off Site Subdrain Plan, and Exhibit “K, Landscal
Planting Plan. A right of way permit will be required to conduct this work.

37. Prior to building permit issuance, the applicant shall initiate and complete a qu

39. The Developer shall be responsible for all fees, deposits, and charges which will 1
collected before and/or at the time of issuance of the building permit. The Si
Diego County Water Authority capacity charge will be collected at issuance
application for meter installation.
40. Sequentially, the Developer’s Engineer shall do the following:

EDU).
41. This project is approved upon the express condition that building permits will not k
issued for development of the subject property unless the water district serving th
development determines that adequate water service and sewer facilities are availab:
at the time of application for such water service and sewer permits and will contint
to be available until time of occupancy.
Fire Conditions:
42. Prior to the issuance of building permits, complete building plans shall be submitte
to and approved by the Fire Department.
43. Additional onsite public hydrants are required.
44. Applicant shall submit a site plan to the Fire Department for approval, which depic
location of required, proposed and existing hydrants. The plan should include off-si
fire hydrants within 200 feet of the project.
45. An all-weather access road shall serve the project during construction. When in tl
opinion of the Fire Chief, the access road has become unserviceable due to incleme:
weather or other reasons, he may, in the interest of public safety, require th
construction operations cease until the condition is corrected.
46. Private roads and driveways which serve as required access for emergency servic
vehicles shall be posted as fire lanes in accordance with the requirements of Sectic
17.04.020 of the Carlsbad Municipal Code.
47. Plans and/or specifications for fire alarm systems, fire hydrants, automatic sprinkl(
systems and other fire protection systems shall be submitted to the Fire Departme
for approval prior to construction.
48. An approved automatic fire sprinkler system shall be installed in buildings having i
aggregate floor area exceeding 10,000 square feet.
