PLANNING COMMISSION RESOLUTION NO. 3724
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO ALL SIX SEGMENTS
OF THE CARLSBAD LOCAL COASTAL PROGRAM TO
MAKE THE ZONING CODE (WHICH FUNCTIONS AS THE
IMPLEMENTING ORDINANCE FOR THE LOCAL COASTAL
PROGRAM) AND THE LOCAL COASTAL PROGRAM
CONSISTENT BY AMENDING VARIOUS CHAPTERS OF THE
ZONING ORDINANCE DEALING WITH SENIOR CITIZEN
HOUSING AND SECOND DWELLING UNITS.

lo II WHEREAS, California State law requires that the Local Coastal Program, Gene]
11 Plan, and Zoning designations for properties in the Coastal Zone be in conformance;
12 WHEREAS, a verified application for an amendment to the Local Coas
l3 1 herein, has been filed with the Planning Commission; and l4

on the 2 1st day of December, 1994, hold a duly noticed public hearing as prescribed by law 19
WHEREAS, the Planning Commission did on the 7th day of December, 1994 a
1 consider the proposed Local Coastal Program Amendments shown on Exhibit “LCPA 94-01

23 WHEREAS, at said public hearing, upon hearing and considering all testimony ar
24 arguments, if any, of all persons desiring to be heard, said Commission considered all facto
25 relating to the Local Coastal Program Amendment.
26 WHEREAS, State Coastal Guidelines requires a six week public review period f
WHEREAS, said verified application constitutes a request for amendment
provided in Title 21 of the Carlsbad Municipal Code; and
dated December 7, 1994, attached hereto, and;
27 11 any amendment to the Local Coastal Program.

NOW, THEREFORE, BE JT HEREBY RESOLVED by the Planning Commissic
of the City of Carlsbad, as follows:
A) That the foregoing recitations are true and correct.
B) At the end of the State mandated six week review period, starting on October 21
1994, and ending on December 2, 1994, no public comments had been receive
C) That based on the evidence presented at the public hearing, the Commissic
recommends APPROVAL of LCPA 94-02, as shown on Exhibit "LCPA 94-02
dated December 7, 1994, attached hereto and made a part hereof based on tl
following findings:
Findings :
1. The proposed Local Coastal Program Amendment is consistent with all applicable policil
of the City of Carlsbad Local Coastal Program.
2. The proposed amendment is required to maintain consistency between the Zoning Coc
and the Local Coastal Program.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the Plannir
Commission of the City of Carlsbad, held on the 21st day of December, 1994, by the followit
vote, to wit:
AYES: Chairperson Savary; Commissioners Welshons, Noble, Erwi
Compas, Nielsen, and Monroy.
NOES: None.
ABSENT: None.
ABSTAIN: None.
