CASE NAME RANCHO CARRILLO VILLAGES “F”, CASE NO: CT 93-07 WHEREAS, a verified application has been filed with the City of RECOMMENDING APPROVAL OF CT 93-07, ON “G”, AND T” and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provide1 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Commission did, on the 16th day of November, 1994, the 30th day of November, 3 on the 4th day of January, 1995, hold a public hearing on property described as: That portion of Section 18 and 19, Township 12 South, Range 3 West, and Section 24, Township 12 South, Range 4 West. WHEREAS, at said public hearing, upon hearing and considering all t and arguments, if any, of all persons desiring to be heard, said Commission consi factors relating to CT 93-07. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the COI RECOMMENDS APPROVAL of Carlsbad Tract CT 93-07, base’ following findings: Findings: I. The proposed map and its design and improvements are consistent with thc General Plan, the Rancho Carrillo Master Plan (MP 139(E)), and with a ~ " 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 provisions of Title 21, to include but not be limited to, Chapters 21.06, 21.: 21.45, 21.53, 21.90, and 21.95. 2. The site is physically suitable for the type and proposed density of develol exhibited via a review of the existing General Plan and Rancho Carrillo Mas 3. Findings were not made pursuant to Section 21081.(c) of the Public Resour that specific economic, social or other considerations make infeasible the II measures of project alternatives identified in the environmental impact re 4. The design of the subdivision is not likely to cause serious public health prc analyzed in the Certified Environmental Impact Report (EIR 91-04). 5. The design of the subdivision or the type of improvements will not con easements of record or easements established by court judgement, acquirc public at large, for access through or use of property within the proposed sul In this connection the City Council has approved via the Carrillo Ran Agreement alternate easements for access or for use that will be provided these will be substantially equivalent to ones previously acquired by the p 6. The proposed map meets and performs all of the requirements and conc Title 20 and the Subdivision Map Act as all necessary design, dc improvements, and agreements necessary to actualize such performance 1 met or been conditioned to be met via this resolution. 8. The project is not a conversion of residential real property to condl community apartments or stock cooperatives. 9. The property is not subject to a contract entered into pursuant to 1 Conservation Act of 1965 so there is no necessity to make a determination to sustain agricultural use according to the provisions of Section 66474.4 of Government Code nor to determine exception status. 10. The proposed tentative map complies with all requirements of Hillside Dew Permit 91-17 and therefore with all requirements of the hillside dev regulations, Chapter 21.95 of the Carlsbad Municipal Code. 11. The proposed project is compatible with the surrounding future land I: surrounding properties are designated for residential development on thc Plan. 12. The applicant is by condition, required to pay any increase in public facilii new construction tax, or development fees, and has agreed to abide by any a requirements established by a Local Facilities Management Plan prepared to Chapter 21.90 of the Carlsbad Municipal Code. This project is consistent with the City’s Growth Management Ordinance been conditioned to comply with any requirement approved as part of t Facilities Management Plan for Zone 18. 15. The Tentative Tract Map satisfies all requirements of Title 20 and 21 of the Municipal Code (except as may be modified for affordable housing incent the State Subdivision Map Act. 16. The proposed subdivision implements the Rancho Carrillo Master Plan MI 17. The proposed project’s design and density of the development portion of t compatible with surrounding development and does not create a disharmc disruptive element to the area, because the Tentative Tract Map meet! standards and the proposed residential densities are consistent with the Gen and the Carrillo Ranch Master Plan. The surrounding villages and properties are either existing residential development or are planned for rt development, therefore, the proposed residential development would be ca with the area. 18. Such use will not be detrimental to the health, safety or general welfare o residing or working in the vicinity, or injurious to property or improveme] vicinity, because the Tentative Tract Map (CT 93-07) meets all requi standards and ordinances, all public facilities and services will be prov adequate setbacks and buffers from the proposed nearby community park, family residential and single family residential uses and Melrose Drive k incorporated into the project design. 21 22 24 20. All approvals of permits required by Title 21 have been given or issued for or will be given concurrently with this permit. The project site has an Master Plan, and Hillside Development Permit. A Planned Development PC a Site Development Plan are being processed concurrently. Planning Conditions: 1. Approval is granted for CI’ 93-07, as shown on Exhibits “A - “S”, dated St 7, 1994, (except that within 60 days of final approval of this project the arc1 data sheets shall be revised to reflect all applicable requirements of the Village Design Guidelines) incorporated by reference and on file in the Department. Development shall occur substantially as shown unless othem in these conditions, and approved by the Planning Director or City Engin1 2. Approval of CT 93-07 is granted subject to the approval of PUD 93-06 and 01. 3. The developer shall provide the City with a reproducible 24” x 36” mylar cc Tentative Map as approved by the Planning Commission. The Tentative P reflect the conditions of approval by the City. The Map copy shall be sub the City Engineer and approved prior to building, grading, final improvement plan submittal, whichever occurs first. 4. A 500’ scale mylar of the subdivision shall be submitted to the Planning prior to the recordation of the final map. Said map shall show all lots a] within and adjacent to the project. 5. This project is also approved under the express condition that the applican public facilities fee adopted by the City Council on July 28, 1987 (amende 1991) and as amended from time to time, and any development fees estab: the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code ordinance adopted to implement a growth management system of facil: improvement plan and to fulfill the subdivider's agreement to pay the public fee dated July 13, 1993, a copy of which is on file with the City Cler incorporated by this reference. The applicant shall prepare a detailed landscape and irrigation plan which submitted to and approved by the Planning Director prior to the approval o or building plans, whichever occurs first. 28. All landscape and irrigation plans shall be prepared to conform with the L Manual and submitted per the landscape plan check procedures on fil Planning Department. 29. All landscaping shall comply with the landscape requirements of the Carrill Master Plan and the City’s Landscape Guidelines Manual. 30. The developer shall include top-soil preservation and rollback and redi, cutlfill slopes and open space areas proposed for native revegetation tl stability and growth subject to the approval of the City Engineer and 1 Director. The applicant shall pay a landscape plan check and inspection fee as req Section 20.08.050 of the Carlsbad Municipal Code. 33. The first set of landscape and irrigation plans submitted shall include buildil improvement plans and grading plans. 34. All building pad and street areas of Villages “F”, “G, and “P that are grad1 HDP 91-17 and remain vacant or undeveloped for a period of more than 6 after the grading operation is completed shall be seeded to reduce erosion ar impacts. If grading is phased, the six months time period shall star completion of each individual grading phase. Signs and Identification: 35. Building identification and/or address shall be placed on all new and buildings so as to be plainly visible from the street or access road; identification and/or address shall contrast to their background color. 36. Any signs proposed for this development shall at a minimum be desi conformance with the City’s Sign Ordinance and shall require review and i of the Planning Director prior to installation of such signs. 1 37. This project shall comply with all conditions and mitigation measures j within the attached mitigation monitoring report and reporting program “l”), which are required as part of Environmental Impact Report for thc Carrillo Master Plan EIR 91-04, certified by City Council on July 27,199 39. Prior to issuance of a grading or building permit, whichever occurs first, : soils contamination report shall be prepared and submitted to the City f and approval by the City Engineer. The detailed soils contamination rei. include a soils contamination remediation plan. If remediation is determil unnecessary, the report shall so indicate. 40. Consistent with EIR 91-04, impacts to sensitive and significant habitat mitigated under the review and supervision of the California Department of Game, the U.S. Army Corp of Engineers and any other applicable resourct The mitigation plan must be approved by the involved resource agencies pri recordation of final map. Grading plans shall reflect the resource agencit and approval. Prior to the issuance of any grading permits or final map, whichever occurs applicant shall submit for review and approval to the City Engineer a Mitigation Plan. The Riparian Mitigation Plan may include participatic City's Habitat Management Plan. Mitigation shall be accomplisha satisfaction of the City and in accordance with the requirements of Sectiol seq. of the California Fish and Game code and Section 404 of the Fedel Water Act. If such plan includes on-site mitigation the applicant shall SZI review and approval by the Planning Director a data recovery program 4691B if disturbed by the mitigation plan. 49. Paleontoloa a. This project must comply with all requirements of SDP 94-01 in the prc affordable housing units. 51. This project is approved, subject to the condition that the required inclusion shall be constructed concurrent with the project market rate units, unless final decision making authority of the City and the developer agree, w Affordable Housing Agreement, to an alternate schedule and/or loca development. Any request for locational modification of Affordable Housi granted standards modifications shall be presented to the Planning Commi the process described in Title 21.45.160, for a major amendment. 52. An appropriately worded statement clearly identiwng the resp shall be placed in the CC&Rs. Approval of this tentative tract map shall expire twenty-four (24) months date of City Council approval unless a final map is recorded. If any finr recorded for this project prior to the tentative map expiration date, expiration date of the conditionally approved tentative map shall be extl accordance with Section 66452.6(a) of the Subdivision Map Act. If a final not been recorded, an extension may be requested by the applicant. Said c shall be approved or denied at the discretion of the City Council.
