A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA,
DEVELOPMENT OF 90 AFFORDABLE HOUSING UNITS
ON PROPERTY GENERALLY LOCATED NORTH OF
THE BATIQUITOS LAGOON WITHIN PLANNING AREA
“D” OF THE POINSETTIA SHORES MASTER PLAN

WHEREAS, a verified application has been filed with the City of Q
RECOMMENDING APPROVAL OF SDP 94-08 FOR THE
and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request for
Development Plan as provided by Chapters 21.06 and 21.86 of the Carlsbad Mu
Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the P1;

WHEREAS, at said public hearing, upon hearing and considering all tesl
and arguments, if any, of all persons desiring to be heard, said Commission conside
factors relating to SDP 94-08.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1:
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the P1i
Commission RECOMMENDS APPROVAL of Site Development Plan, SDP
based on the following findings and subject to the following conditions:

Findings:
1. That the requested use is properly related to the site, surrounding
environmental setting, is consistent with the various elements and objectives
general plan, will not be detrimental to existing uses or to uses specifically per

3. That all of the yards, setbacks, walls, fences, landscaping, and other fc

The incentives involved with this project include: (1) the reduction of a st
covered parking space from 8% ft by 20 ft (standard) to 8% feet by 17
(incentive), (2) the provision of storage space per unit per the Planned Develc
Ordinance ranging from 377-409 cubic feet (incentive) which is less th
standard of 480 cubic feet per unit, and (3) the allowance of three compac

spaces. These incentives will allow the development of the requested use s

4. That the street system serving the proposed use is adequate to properly haK
traffic generated by the proposed use as indicated in the Poinsettia Shores 1
Plan and corresponding Mitigated Negative Declaration. The street system !

5. All requirements of the California Environmental Quality Act have been met tl
the environmental review performed for the Master Plan (MP 175(D)) and 1
Tentative Map (CT 94-01) which resulted in two publicly noticed Mitigated N
Declarations. All applicable mitigation measures identified have either been i
completed or are designed into the project so that no environmental impac
result from the proposed project. A Notice of Prior Compliance was issl
January 4,1995.
Planning Conditions:
1. Approval is granted for SDP 94-08, as shown on Exhibits “A” - “K”,
February 15, 1995, incorporated by reference and on file in the P1
Department. Development shall occur substantially as shown unless 0th
noted in these conditions.
2. Approval of SDP 94-08 is granted subject to the approval of C-T 94-
PUD 94-03. SDP 94-08 is approved subject to all conditions of apprc
