HomeMy WebLinkAbout1995-04-05; Planning Commission; Resolution 3758r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 3758 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A CONDOMINIUM FAMILY HOMES ON PROPERTY GENERALLY LOCATED NORTH OF THE BATIQUITOS LAGOON SHORES MASTER PLAN CASE NAME: POINSETTIA SHORES - AREA “B-1” CASE NO: CP 94-01 WHEREAS, a verified application has been filed with the City of C PERMIT, CP 94-01, FOR 158 CLUSTERED SINGLE WITHIN PLANNING AREA “B-1” OF THE POINSETTIA and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request for a Planni Development as provided by Chapter 21.45 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the PI Commission did on 5th day of April, 1995, hold a public hearing on property descri Lot 5 of Carlsbad Tract 94-01, in the City of Carlsbad, County of San Diego, State of California, according to Map No. 13181 filed in the office of the San Diego County Recorder. WHEREAS, at said public hearing, upon hearing and considering all tes and arguments, if any, of all persons desiring to be heard, said Commission conside factors relating to CP 94-01. NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1 Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the P1; Commission RECOMMENDS APPROVAL of Condominium Permit, CP 94-01! on the following findings and subject to the following conditions: .... .... .I il 0 0 1 Findings: 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1. That the granting of this permit will not adversely affect and will be consistt Chapter 21.45 of Title 21, the General Plan, applicable specific plans, maste and all adopted plans of the City and other governmental agencies, in 1 proposed project implements the approved Poinsettia Shores Master I consistent with the provisions, standards and design criteria of the 1 Development Ordinance (Chapter 21.45 of the Municipal Code), the Zone Facilities Management Plan documents including the Zone 9 Finance Plan, West Batiquitos Local Coastal Program as certified by the Coastal Commis 2. That the proposed use at the particular location is necessary and desirable to a service or facility which will contribute to the long-term general well-bein; neighborhood and the community, in that buildout of the Master Plan will COI to the long term general welfare of the area by providing development consistc the City’s General Plan. The project represents a diversified element Poinsettia Shores community. The location for this use is reflected in the 1 General Plan and Master Plan for the site, which was amended and appri appropriate action of the City Council in 1994 at a duly noticed public hc The Plan is divided into residential planning areas and open space area! Condominium Permit for Planning Area “B-1” accurately and properly imp the approved Master Plan. 3. That such use will not be detrimental to the health, safety, or general we persons residing or working in the vicinity, or injurious to property or impro1 in the vicinity, since the project is partial buildout of a comprehensive mas1 which will provide major infrastructure and public improvements that will t the general welfare of the City. In addition, the project is designed to functic applicable City standards and will be consistent with the City’s General PI: 4. That the proposed Planned Development meets all of the minimum devel standards set forth in Chapter 21.45.090, the design criteria set forth in 21.45.080, and has been designed in accordance with the concepts containec Design Guidelines Manual, in that no deviations or modifications fr development standards of Chapter 21.45 are involved and all design criter been satisfied including: (a) a functional relationship between stn landscaping and open space areas; (b) the provision of adequate usable ope1 street systems, recreational opportunities and adequate resident and guest spaces; (c) compatibility with existing and future permitted land uses wl creating a disruptive element to the community; (d) the provision of an street system that does not dominate the project’s design or conflict w recreational areas, trail areas, parking locations or other common arm project; (e) the provision of adequate recreation facilities; and (f) structures 1 promote architectural harmony. 27 28 5. That the proposed project’s design and density of the developed portion of is compatible with surrounding development and does not create a disharmo~ disruptive element to the neighborhood, in that all applicable provisic complied with so that no disruptive elements will be created by the buildou Master Plan. 7. That the project’s circulation system is designed to be efficient and well int with the project and does not dominate the project, in that the proposed circ system meets all standards while not dominating the project or adversely im 9 ll any of the project’s features or amenities. 10 ll PlanninPr Conditions: 11 12 13 14 15 16 1. The Planning commission does hereby recommend approval of the Condo Permit for the Poinsettia Shores Project entitled “Planning Area B-1”, date 5, 1995, (Exhibits “A” - “0”, dated April 5, 1995, incorporated by this reft subject to the conditions herein set forth. Staff is authorized and directed t or require the Developer to make all corrections and modifications to the 1 exhibits and/or documents, as necessary to make them internally consistc conform to City Council’s final action on the Project.
