A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNING COMMISSION DETERMINATION TO ALLOW
THE CONTINUED OPERATION OF A TEMPORARY REAL
ESTATE SALES TRAILER WITHIN AVIARA POINT
(PLANNING AREA 13) ON THE WEST SIDE OF AVIARA
DRIVE, BETWEEN ALGA ROAD AND BATIQUITOS DRIVE.

WHEREAS, a verified application for certain property, to wit:
Lot 286 of Carlsbad Tract 85-35, Aviara Phase I Unit D in the
City of Carlsbad, County of San Diego, according to Map No.
12412, filed on June 28, 1989 in the Office of the County
Recorder, County of San Diego, State of California,
has been filed with the City of Carlsbad, and referred to the Planning Commissj
WHEREAS, said verified application constitutes a request for a 1
Commission Determination as provided by Title 21 of the Carlsbad Municipal Cc
WHEREAS, the Planning Commission did, on the 5th day of Apl

NOW, THEREFORE, BE IT HEREBY RESOLVED by the 1

A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commissio

2. There is good cause to continue the placement and occupation of a tempor;
estate sales trailer, as shown in Exhibit "A", dated April 5, 1994, because
extended time scale involved with development of master plans and the c

Conditions:
1. The Planning Commission does hereby approve the Planning Coml
Determination for the Aviara Point Sales Trailer project entitled "PCD 9:
(Exhibit "A" attached hereto and incorporated by this reference, dated 1
