HomeMy WebLinkAbout1995-04-19; Planning Commission; Resolution 3774I- 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 PLANNING COMMISSION RESOLUTION NO. 3774 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A MINOR MASTER PLAN AMENDMENT TO PROVISION OF THE POINSETTIA SHORES MASTER PLANS AFFORDABLE HOUSING REQUIREMENT DESIGNATE THE OFF-SITE OPTION FOR THE CASE NAME: POINSETTIA SHORES - MINOR AMENDMENT CASE NO: MP 175(F) WHEREAS, a verified application has been filed with the City of ( and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request for a mino plan amendment as provided by Chapter 21.38 of the Carlsbad Municipal Code; ; WHEREAS, pursuant to the provisions of the Municipal Code, the 1 Commission did, on the 19th day of April, 1995, consider said request; WHEREAS, at said meeting, said Commission considered all factors to MP 175(F). NOW, THEREFORE, BE IT HEREBY RESOLVED by the 1 Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. ' B) That based on the evidence presented at the meeting, the Con APPROVES MP 175(F), based on the following findings and subjec following conditions: Findings: 1. The proposed minor amendment is consistent with the intent of the P8 Shores Master Plan (MP 175-D) as approved by the City Council on Ja 1994. 2. The proposed amendment is consistent with the provisions of Chapter 21.: Carlsbad Municipal Code and complies with the criteria for a minor ma$ amendment. .... 4 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e 3. The proposed minor amendment designating the off-site option as the m wh'ich the master plan will satisfy its affordable housing requirement adversely impact the implementation of the Poinsettia Shores Master Plan; ( conflicts with the original City Council approval of the master plan. The I Commission finds the amendment minor in nature and, in accordance with 21.38.120(a)(2), incorporates this amendment with the original City Council t of the master plan. Conditions: 1. Approval is granted for MP 175(F), as shown om Exhibit "A", dated April I The applicant shall provide replacement pages and updated diskette for thc plan text in substantial conformance with Exhibit "A" to the satisfactio! Planning Director within 60 days of approval of this amendment. 2. Approval of this request shall not excuse compliance with all sections of the Ordinance, Poinsettia Shores Master Plan and all other applicable City or( in effect at the time of approval of the minor master plan amendment. 3. If an Affordable Housing Agreement for the off-site provision of affordable units is not approved by the City Council, then Uhe on-site project, Area D lO/CP 94-O3/SDP 94-08 will remain valid and active with a recommend approval per Planning Commission action of February 15,1995 and can pr the City Council for final action so that the Poinsettia Shores Master I satisfy its affordable housing requirement. .... .... .... .... .... .... .... .... .... .... ....
