HomeMy WebLinkAbout1995-09-20; Planning Commission; Resolution 3811* 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 l? 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 3811 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FROM OFFICE AND RELATED COMMERCIAL (0) TO RESIDENTIAL HIGH (RH) ON PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF THE ALGA ROAD/ COBBLESTONE ROAD INTERSECTION, IN LOCAL FACILITIES MANAGEMENT PLAN ZONE 5. CASE NAME: LAUREL TREE APARTMENTS CASE NO: GPA 95-01 WHEREAS, a verified application for an amendment to the Gener designation for certain property located, as shown on Exhibit(s) "X!, dated Septem 1995, attached and incorporated herein, has been filed with the Planning Commissic WHEREAS, said verified application constitutes a request for a Gene] Amendment as provided in Government Code Sections 65350 et seq. and Section 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 20th day of Sepl 1995, hold a duly noticed public hearing as prescribed by law to consider said re( WHEREAS, at said public hearing, upon hearing and considel testimony and arguments, if any, of all persons desiring to be heard, said Corn considered all factors relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the P Commission of the City of Carlsbad, as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Corn recommends APPRQVAL of GPA 95-01, based on the following fin& subject to the following conditions: .... The proposed General Plan Amendment from Office and Related Commerc to Residential High (RH), to enable the development of lower income affc housing, is consistent with the goals and policies of the various elements General Plan. Specifically, Housing Element Policy 3.7.h. allows the i approve General Plan Amendments to increase residential densities to ena development of affordable housing subject to (1) a proposal being compatib adjacent land uses, (2) the adequacy of public facilities, and (3) the projec located in proximity to employment opportunities, urban services or major This high density residential land use designation complies with these three t in that: (1) the use is compatible with surrounding lower density residenti use designations to the south, east and west and non-residential designatio1 north; (2) public facilities are adequate to accommodate the development property consistent with this high density residential land use; (3) this appropriate for a high density residential land use and complies with the ( Plan’s locational criteria for affordable housing because the site is located a to a major roadway (Alga Road), and is in close proximity to empl opportunities (located along Palomar Airport Road) and a future communi (Poinsettia) which is located 112 mile to the southwest. 2. This General Plan Amendment complies with Residential Policy C.l, C.4 s of the Land Use Element of the General plan in that: A. this land use change will enable the development of affordable hou the City; B. multi-family uses will be located near employment centers and transportation corridors; and C. this higher density residential use will be located in an area whe compatible with adjacent land uses, and where adequate public ! systems such as streets, parking, parks, and schools are adequate to service. 3. This General Plan Amendment also complies with Growth Management 1 C.l, C.2 and C.8 of the Land Use Element of the General Plan in that: A. adequate provision has been made for public facilities and ! concurrent with need; I B. all public facilities performance standards will be complied with; a C. the Citywide and Southwest Quadrant dwelling unit limitations Growth Management Plan will not be exceeded. 4. Implementation of the RH land use designation would reduce the num potential vehicle trips, thereby improving circulation within the project vic 6. The uses allowed by the proposed RH land use designation will be compatib surrounding land uses. Conditions: 1. Approval of GPA 95-01 is granted subject to the approval of the Mitigated N Declaration, ZC 95-01, LCPA 95-02, LFMP 87-05(B), SDP 95-01, and HDP 3. This General Plan Amendment is approved subject to the condition that the ~ property is developed exclusively with affordable housing.
