HomeMy WebLinkAbout1995-09-20; Planning Commission; Resolution 38131 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 la 19 20 21 22 23 24 25 26 27 28 e 0 PLANNING COMMISSION RESOLUTION NO. 3813 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE CARLSBAD LOCAL COASTAL PLAN TO BRING THE DESIGNATIONS ON THE LOCAL COASTAL PLAN, GENERAL PLAN, AND ZONING MAP INTO CONFORMANCE ON PROPERTY LOCATED AT THE NORTHEAST CORNER OF THE ALGA ROAD/COBBLESTONE ROAD INTERSECTION, IN LOCAL FACILITIES MANAGEMENT PLAN ZONE 5. CASE NAME: LAUREL TREE APARTMENTS CASE NO: LCPA 95-02 WHEREAS, California State law requires that the Local Coastal Program, ( Plan, and Zoning designations for properties in the Coastal Zone be in conformance; WHEREAS, a verified application for an amendment to the Local Coastal E: Land Use Plan designations for certain property located, as shown on Exhibit “Z1 September 20, 1995, attached and incorporated herein, has been filed with the P Commission; and WHEREAS, said verified application constitutes a request for a Local Program Amendment as provided in Public Resources Code Section 30574 and Articl Chapter 8, Subchapter 2, Division 5.5 of Title 14 of the California Code of Regulation; California Coastal Commission Administrative Regulations; and WHEREAS, the Planning Commission did on the 20th day of Septembe hold a duly noticed public hearing as prescribed by law to consider the proposed Local Program Amendment shown on Exhibit “Z”, and; WHEREAS, at said public hearing, upon hearing and considering all testim arguments, if any, of all persons desiring to be heard, said Commission considered all relating to the Local Coastal Program Amendment. .... ~ I1 0 0 1 WHEREAS, State Coastal Guidelines requires a six week public review pel 2 3 any amendment to the Local Coastal Program. 4 II NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Corn 5 11 of the City of Carlsbad, as follows: €j I1 A) That the foregoing recitations are true and correct. 7 8 9 10 11 B) At the end of the State mandated six week review period, starting on A 1995, and ending on June 3, 1995 staff shall present to the City Co summary of the comments received. C) That based on the evidence presented at the public hearing, the Corn recommends APPROVAL of LCPA 95-02 to amend the Mello II Land U map as shown on Exhibit "Z", dated September 20, 1995 attached her€ made a part hereof based on the following findings: ~ l2 I/ - Findings: 13 1. That the proposed Local Coastal Program Amendment is consistent with all apl 14 policies of the Mello II segment of the Carlsbad Local Coastal Program, in that: 15 16 (a) the Mello II policy regarding the preservation of steep slopes wil without sensitive vegetation is being complied with; 17 II (b) all project environmental impacts have been mitigated; 18 19 20 21 (c) the project contains prime agricultural soil (Class IJ) and ha: conditioned to mitigate the conversion of this prime agricultural 1a1 residential use; (d) the development of the project site, as proposed on the associate Development Plan, would not preclude or negatively affect agricultu~ 22 ll on the adjacent property to the north; and 23 24 (e) the project, as proposed on the associated Site Development Plan, will i an onsite de-pollutant basin to control drainage and prevent erosic Encinas Creek. 25 26 2. That the proposed amendment to the Mello II segment of the Carlsbad Local 1 Program is required to bring the designations of the City's General Plan Land U! (as amended), Zoning Map (as amended) and Mello 11 Land Use Plan into confor 27 // Conditions: 28 1. Approval of LCPA 95-02 is granted subject to the approval of the Mitigated N Declaration, GPA 95-01, ZC 95-01, LF”P 87-05(B), SDP 95-01, and HDP 9 3. This Local Coastal Program Amendment is approved subject to the conditic the subject property is developed exclusively with affordable housing. PASSED, APPROVED, AND ADOPTED at a regular meeting of the P Commission of the City of Carlsbad, held on the 20th day of September, 1995, by the fo vote, to wit: AYES: Chaqxrson Welshons, commissioners Savary, Noble, Nie: Compas.
