CASE NAME: LAUREL TREE APARTMENTS CASE NO: LFMP 87-05(B) WHEREAS, a verified application has been filed with the City of Carls referred to the Planning Commission, and WHEREAS, the City Council passed Resolution No. 8797 adopting t: Citywide Facilities and Improvements Plan establishing facility zones and performance s for public facilities, and WHEREAS, the City Council adopted Ordinance No. 9808 requb processing of a Local Facilities Management Plan, and WHEREAS, the City Council adopted Ordinance No. 8 1 10 and 9829 imple Proposition E approved on November 4, 1986 by the citizens of Carlsbad, and WHEREAS, said verified application constitutes a request for a Local E Management Plan Amendment as provided in Carlsbad Municipal Code Section 21.90. WHEREAS, the Planning Commission did, on the 20th day of Septembc hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testin arguments, if any, of all persons desiring to be heard, said Commission considered a1 relating to the amendment to the buildout projections and public facilities and service of the Local Facilities Management Plan for Zone 5. i NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Con as follows: 1 2 3 4 5 6 7 8 9 16 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Corn recommends APPROVAL of an amendment to the buildout projections an facilities and services analysis for hal Facilities Management Plan - based on the following findings and subject to the following condition: Findings: 1. That the Local Facilities Management Plan amendment for Zone 5 is consistent Land Use Element, and the other Elements contained in Carlsbads General Plan consistent with Growth Management Policies C.l, C.2 and C.8 of the La Element of the General Plan: a. adequate provision has been made for public facilities concurrent wil b. all public facilities performance standards will be complied with, an c. the Citywide and Southwest Quadrant dwelling unit limitations of the Management Plan will not be exceeded. 2. That the Local Facilities Management Plan amendment for Zone 5 is consist Section 21.90 of the Carlsbad Municipal Code (Growth Management), and 7 Citywide Facilities and Improvement Plan, in that this Facility Plan has been a consistent with Section 21.90.110, and all facility and service impacts (dc associated with the proposed land use change have been analyzed and a mitigation measures incorporated where required. 3. That the Local Facilities Management Plan amendment for Zone 5 and the cc contained therein will continue to promote the public safety and welfare by ensu public facilities will be provided in conformance with the adopted performance s and will be available prior to development occurring, in that all public facilir services required for the 138 unit residential project (Site Development Pli 95-01)), processed in association with this LFMP amendment, are either ah place or will be provided through conditions of approval placed on this res project.
