CASE NAME CARLSBAD RANCWLEGOLAND CASE NO: LFMP 87-13(B) SPECIFIC PLAN AMENDMENT ~ 11 12 13 14 WHEREAS, said application constitutes a request for Local Fa 15 Management Plan Amendments for Zones 5 and 13 (dated October 1995 on file 16 Planning Department) and incorporated by this reference (collectively referred to ' 7 "Local Facilities Management Plan Amendments"), as provided in Section 21.90.125 l8 Carlsbad Municipal Code; and 19 20 21 WHEREAS, Carltas Company has filed a verified application with tl of Carlsbad which has been referred to the Planning Commission, and i. .. WHEREAS, the Planning Commission did, on the 6th day of December hold a duly noticed public hearing as prescribed by law to consider said request; an 22 WHEREAS, at said public hearing, upon hearing and considering all tesl 23 and arguments, if any, of all persons desiring to be heard, said Commission conside . .. 24 factors relating to the Local Facilities Management Plan Amendment for Zone 13. 25 26 27 28 NOW, THEREFORE, BE IT HEREBY RESOLVED by the PI: Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comrr x. I1 ll 0 e $ : 1 2 3 4 5 6 7 8 9 RECOMMENDS APPROVAL of an amendment for Local Fz Management Plan - Zone 13 and a concurrent amendment to the Facilities Management Plan for Zone 5 to transfer 20.66 acres frc facilities zone to Zone 13 based on the following findings and subjecf following condition: Findings: 1. That the Local Facilities Management Plan for Zone 13 is consistent with thl Use Element, the Public Facilities Element, and the other Elements conta~ Carlsbad’s General Plan, in that consistent with Growth Management Polici C2 and C3 of the Land Use Element of the General Plan: a. adequate provision has been made for public facilities concurrent wit1 lo il b. all public facilities performance standards will be complied with, ani 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 c. funding for all necessary public facilities and services will be gual prior to any development approvals, grading or building permits. ~ 2. That the Local Facilities Management Plan for Zone 13 is consistent with ! 21.90 of the Carlsbad Municipal Code (Growth Management), as amen1 Ordinance No. 8110 and Ordinance No. 9829 and with the adopted 1986 C Facilities and Improvement Plan, in that this Facility Plan has been ar consistent with Section 21.90.110, and all facility and service impacts (del associated with the proposed land use changes have been analyzed and ac mitigation measures incorporated where required. 3. That the Local Facilities Management Plan for Zone 13 and the conditions COI therein will promote the public safety and welfare by ensuring that public fz will be provided in conformance with the adopted performance standards and available prior to development occurring, in that all public facilities and s required for the development of the Carlsbad Ranch Specific Plan Amendmc 207(A)), processed in association with this LFMP amendment, are either alr place or will be provided through conditions of approval placed on the tentative map. 4. Approval is granted for an amendment to Local Facilities Management Plan 13 as contained in the Plan titled Local Facilities Management Plan Zone 13 October, 1995, incorporated herein by reference. The amended Zone 12 Facilities Management Plan, dated October 1995 shall replace in its entir Zone 13 LFMP dated May 6,1992. 2. Approval of LFMP 87-13(B) is granted subject to the approval of EIR 94-0 94-03, LCPA 90-O8(B), ZC 94-02, SP 207(A), and AP 76-010). LFMP 87-1 subject to all conditions contained in Planning Commission Resolution No( for the Program EIR. PASSED, APPROVED, AND ADOPTED at a regular meeting Planning Commission of the City of Carlsbad, California, held on the 6th day of Dec 1995, by the following vote, to wit: AYES: Chairperson Welshons, Commissioners Compas, Nielsen and Savary NOES: Commissioner Erwin and Monroy ABSENT: None ABSTAIN.
