CASE NAME GREEN VALLEY MASTER PLAN CASE NO. MP 92-01 WHEREAS, Carlsbad Partners Limited has filed a verified applicati the City of Carlsbad and which has been referred to the Planning Commission; an WHEREAS, said verified application constitutes a request for a Mas1 as provided by Section 2138.040 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the P Commission did, on the 19th day of January, and the 2nd day of February, 1994, 13th day of December, 1995, consider said request for a Master Plan on property de as: A portion of Section 2, Township 13 South, Range 4 West; and a portion of Section 35, Township 12 South, Range 4 West, San Bernardino Meridian, City of Carlsbad, County of San Diego, State of California. WHEREAS, a Reduced project Alternative has been proposed applicant which reduces the project’s proposed commercial square footage by 300,000 square feet and increases the residential portion to 55.8 acres; and WHEREAS, at said public hearings, upon hearing and consider testimony and arguments, if any, of all persons desiring to be heard, said Coml considered all factors relating to MP 92-01. B) That based on the evidence presented at the public hearing, the Corn RECOMMENDS APPROVAL of Master Plan, MP 92-01, according to "C", and MP 92-01 dated November 29,1995, based on the following and subject to the following conditions: Findings: 1. That the proposed development as described by Master Plan MP 92-01 is ca with the provisions of the General Plan and any applicable specific plans, in proposed land uses and location of proposed land uses are consistent wit identified on the General Plan Land Use map and inclusion of those land USE Master Plan implements the goals and policies of the General Plan. 2. That all necessary public facilities can be provided concurrent with ne adequate provisions have been provided to implement those portions of the Improvement Program applicable to the subject property, in that the Mast includes conditions requiring the completion of infrastructure identified in tt Facilities Management Plan (LFMP) for Zone 23 and will be guarantm financing plan approved by the City Council for LFMP Zone 23. 3. That appropriate measures are proposed to mitigate any adverse enviro impact as noted in the adopted Final Program Environmental Impact Rep( 92-03) for the project, in that the mitigation identified in the EIR has been i as conditions of approval or incorporated into the project and will be mc according to an adopted mitigation monitoring and reporting program. Conditions: 1. Approval is granted for the Green Valley Master Plan, MP 92-01, as desc Ordinance No. (Exhibit "C") which has been amended to reflect the : Project Alternative as described in the Final Program Environmental Impacl EIR 93-02. 3. A reproducible copy minus redlines and strikeouts of the Master Plan as 2 to reflect any modifications required by the Planning Commission and City shall be provided to the City within thirty (30) days of adoption. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING GREEN VALLEY MASTER PLAN FOR PROPERTY GENERALLY LOCATED NORTH AND EAST OF THE CITY OF ENCINITAS, SOUTH OF LA COSTA AVENUE$ AND WEST OF EL CAMINO REAL IN LOCAL FACILITIES MANAGEMENT ZONE 23. CASE NAME: GREEN VALLEY MASTER PLAN CASE NO: MP 92-01 WHEREAS, Carlsbad Partners Limited has reviewed and considered a P Plan as provided by Chapter 21.54 of the Carlsbad Municipal Code; and WHEREAS, after procedures in accordance with the requirements of 12 City Council has determined that the public interest indicates that said plan be apF NOW, THEREFORE, the City Council of the City of Carlsbad, Cal does ordain as follows: SECTION I: That the Green Valley Master Plan, MP 92-01 on file Planning Department is incorporated by reference herein, is approved.
