PLANNING COMMISSION RESOLUTION NO. 3868
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA,
RECOMMENDING APPROVAL OF A ZONE CHANGE
LOCATED ON THE NORTHWEST CORNER OF FUTURE
POINSETTIA LANE AND BLACKRAIL COURT.

WHEREAS, Ocean Bluff has filed a verified application for certain PI
FROM L-C TO R-1 ON PROPERTY GENERALLY
to wit:
Lot 3 in Section 22, Township 12 south, range 4 west, San
Bernadino base and meridian in the County of San Diego, State
of California, excepting therefrom those portions thereof lying
north of the south boundary line of Rancho Agua Hedionda, as
said south line was established May 5, 1913, by decree of the
Superior Court of the State of California, in and for San Diego
County, in that certain action (No. 16830) entitled Kelly
Investment Company, a corporation, vs. Clarence Dayton
Hillman and Bessie Olive Hillman,
has been filed with the City of Carlsbad, and referred to the Planning commission
WHEREAS, said application constitutes a request for a Zone Cha
shown on the maps attached to and incorporated by reference in the Draft City (
Ordinance, Exhibit "X" attached hereto as provided by Chapter 21.52 of the C
Municipal Code; and
WHEREAS, the Planning Commission did on the 20th day of Decembe~
hold a duly noticed public hearing as prescribed by law to consider said request; ax
WHEREAS, at said public hearing, upon hearing and considering all tes
and arguments, if any, of all persons desiring to be heard, said Commission conside
factors relating to the Zone Change; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the PI
Commission as follows:

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Corn
RECOMMENDS APPROVAL of Zone Change, ZC 93-04, based
following findings and subject to the following conditions:
Findings:
1. That the proposed Zone Change from Limited Control (LC) to One
Residential (R-1) is consistent with the goals and policies of the General Pla
Use Element (Policy C.l) in that it will result in "the arrangement of land use
preserve community identity and are orderly, functionally efficient, healthf
aesthetically pleasing."
2. . That the Zone Change will provide consistency between the General P1
Zoning as mandated by California State law and the City of Carlsbad Gene]
Land Use Element, in that the property's underlying Low-Medium Res1
density (RLM) land use designation allows single family residential devel,
except that a variety of overall housing types may be allowed as long as the
density does not exceed 4 dwelling units per acre. Consistent with this poli
proposed project's overall density is 3.6 dwelling units per acre and single fam
multi-family residential units are proposed.
Conditions:
1. Approval of ZC 93-04 is granted subject to the approval of LCPA 95-09, CT
SDP 93-07, and HDP 93-09. ZC 93-04 is subject to all conditions contaj
