HomeMy WebLinkAbout1996-01-03; Planning Commission; Resolution 38741 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 PLANNING COMMISSION RESOLUTION NO. 3874 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDINGAPPROVALOFANAMENDMENTTO THE MELLO I1 SEGMENT OF THE CARLSBAD LOCAL COASTAL PROGRAM TO CHANGE THE ZONING ON TWO PROPERTIES FROM PLANNED COMMUNITY (PC) TO THE ONE-FAMILY RESIDENTIAL ZONE WITH THE QUALIFIED DEVELOPMENT OVERLAY ZONE (R-l- 7500-Q) AND FROM RESIDENTIAL DENSITY - MULTIPLE WITH THE QUALIFIED DEVELOPMENT RESIDENTIAL WITHTHE QUALIFIED DEVELOPMENT GENERALLY LOCATED NORTH OF CAMINO DE LAS ONDAS, EAST OF PASEO DEL NORTE, AND SOUTH OF PALOMAR AIRPORT ROAD, WITHIN SPECIFIC PLAN 203 AND THE COASTAL ZONE, IN LOCAL FACILITIES MANAGEMENT PLAN ZONE 20. CASE NAME MAR VISTA CASE NO: LCPA 94-04 WHEREAS, California State law requires that the Local Coastal Prc OVERLAY ZONE (RDM-Q) TO ONE-FAMILY OVERLAY ZONE(R-1-7500-Q) ON TWO PROPERTIES General Plan, and Zoning designations for properties in the Coastal Zone conformance; WHEREAS, McReynolds and MSP California LLC have filed a vt application for certain property described as: Parcel C of Parcel Map No. 2949, in the City of Carlsbad, County of San Diego, State of California, filed in the office of the County Recorder of San Diego County, August 9,1974, as File No. 74-216632 of official records. AND All that certain parcel of land delineated and designated as "Description No. 1,103.91 Acres" on Record of Survey Map No. 5715, filed in the Office of the County Recorder of San Diego County, December 19,1960, being a portion of Lot G of Rancho Agua Hedionda, according to Map thereof No. 823, filed in the Office of the County Recorder of San Diego County, November 16, 1896, a portion of which lies within the City of Carlsbad, all being in the County of San Diego, State of California. Excepting therefrom that portion lying within Parcels "A", "B", "C" and "D" of Parcel No. 2993 in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, August 23,1974 as File No. 74-230326 of Official Records. li 0 0 . 1 5 4 3 has been filed with the Planning Commission; and 2 located, as shown on Exhibit "Z" , dated January 3,1996, attached and incorporated 1 WHEREAS, said verified application constitutes a request for amendn provided in Public Resources Code Section 30574 and Article 15 of Subchapter 8, C 2, Division 5.5 of Title 14 of the California Code of Regulations of the California ( 6 I1 7 8 hold a duly noticed public hearing as prescribed by law to consider the proposed 9 WHEREAS, the Planning Commission did on the 3rd day of January Commission Administrative Regulations, and; lo Coastal Plan Amendments shown on Exhibit "Z", and; 'l I/ WHEREAS, at said public hearing, upon hearing and considering all tesl 12 13 14 15 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pk 17 for any amendment to the Local Coastal Program. 16 WHEREAS, State Coastal Guidelines requires a six week public review, and arguments, if any, of all persons desiring to be heard, said Commission conside: factors relating to the Local Coastal Program Amendment. ' 8 11 Commission of the City of Carlsbad, as follows: 19 II 20 Ii A) That the foregoing recitations are true and correct. 21 22 23 24 25 B) At the end of the State mandated six week review period, starti November 30,1995, and ending on January 11,1996, staff shall present City Council a summary of the comments received. ~ C) That based on the evidence presented at the public hearing, the Comn WCOMMENDS APPROVAL of LCPA 94-04 as shown on Exhibit "Z", January 3, 1996, attached hereto and made a part hereof based c following findings and subject to the following conditions: 26 28 1. That the proposed amendment to the Mello I1 segment of the Carlsba Coastal Program is required when rezoning related to land use regulations wil Coastal Zone occurs after the certification of a local government's Local Program. Conditions: 1. Approval of LCPA 94-04 is granted subject to the approval of the Recil Mitigated Negative Declaration, ZC 94-04, CT 94-11, SDP 94-10, and HDI LCPA 94-04 is subject to all conditions contained in Planning Commission N 3873,3875,3876, and 3877.
