SP 19(H) FOR THE EXPANSION OF THE TOYOTA CARLSBAD CAR DEALERSHIP ON PROPERTY GENERALLY LOCATED SOUTH OF CANNON ROAD AND EAST OF PASEO DEL NORTE IN THE COASTAL ZONE IN THE NORTHWEST QUADRANT OF THE CITY. CASE NAME: TOYOTA CARLSBAD EXPANSION CASE NO: SP 19(H) WHEREAS, Toyota Carlsbad has filed a verified application with.the Carlsbad and which has been referred to the Planning Commission; and WHEREAS, said verified application constitutes a request for a Speci Amendment as provided by Government Code Sections 65450 et seq; and WHEREAS, pursuant to the provisions of the Municipal Code, the P Commission did, on the 17th day of January, 1996, consider said request on p described as: Lot 1 of Carlsbad Tract 87-03 according to Map No. 122-42 as recorded in the County of San Diego, State of California on October 28, 1988. WHEREAS, at said public hearing, upon hearing and considering all te and arguments, if any, of all persons desiring to be heard, said Commission consid factors relating to SP 19(H). NOW, THEREFORE, BE IT HEREBY RESOLVED by the I Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the COD DENIES Specific Plan Amendment, SP 19(H) and Exhibit "X" attache containing proposed specific plan text and graphic changes, based following findings: /I 0 e c 1 Findings: 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 1. The specific plan amendment proposal to allow Cannon Road access to the site, Lot 1 of the Car Country Expansion specific plan area, cannot be SUI because direct access to major arterials is not consistent with policy establi: the Circulation Element (Implementing Policy C.4 and Table 1: Classifications) of the City’s General Plan. Adequate access for the subj exists via the existing Auto Center Court roadway located at the southeast the site. Access to Lot 1 is also provided internally with the Toyota om operated site adjacent to the west of the subject site, at the southeast corner a del Norte and Cannon Road. Lot 1 was originally subdivided and desi: adequately function without an access to Cannon Road. In addition, the plan amendment request for Cannon Road access cannot be supported bec violates Engineering Standards (Table A) which implement General Plan regarding intersection spacing. The proposed access is 600 feet from the P: Norte intersection to the west and 600 feet from the Car Country Drive intel to the east. Required intersection spacing on major arterials is 1200 feet. I 2. The specific plan amendment proposal to reduce existing and required land along Cannon Road cannot be supported because it would be inconsistent ’I objectives of the City’s Scenic Corridor Guidelines which designates Canna as a Community Scenic Corridor. The Scenic Corridor Guidelines hay incorporated by reference into the Circulation Element for implementati therefore are part of the General Plan. Implementation policy C.6 calls enhancement and preservation of the natural and developed environment each designated scenic route. Reduction of landscaping in general w( inconsistent with this policy and in turn, the General Plan. Specifica reduction of the existing 25 foot landscaped setback area to 10 feet to continuous row of new cars parked/displayed in the same area is not consistc the objective of providing a substantial landscaped amenity to this major i 3. As allowed by Statutory Exemption 15270 (a) and (b) of CEQA (Ca Environmental Quality Act), the CEQA environmental review process does nl to projects which a public agency disapproves or rejects.
