PLANNING COMMISSION RESOLUTION NO. 3886
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, DENYING A
ZONE CODE AMENDMENT TO AMEND TITLE 21,
CHAPTER 10, SECTION 015, OF THE CARLSBAD
MUNICIPAL CODE, BY THE MODIFICATION OF
SUBSECTION 21.10.015(~)(3)(A) TO DELETE THE
PROVISION WHICH ALLOWS A SECOND DWELLING
UNIT OWNER THE OPTION OF FULFILLING THE
OWNER OCCUPANCY REQUIREMENT BY LEASING
BOTH THE MAIN DWELLING UNIT AND THE SECOND
DWELLING UNIT TO A LESSEE.

WHEREAS, the Carlsbad City Council directed that this Zone
Amendment to the Second Dwelling Unit provisions of the Carlsbad Municipal C
processed; and
ORDINANCE AMENDMENT
WHEREAS, the Planning Commission did on the 7th day of Februar,
hold a duly noticed public hearing as prescribed by law to consider said request; a
WHEREAS, at said public hearing, upon hearing and considering all tes
and arguments, if any, of all persons desiring to be heard, said Commission considc
factors relating to the Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the P

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Comr
DENIED Zone Code Amendment, ZCA 95-09, according to Exhil:
dated February 7,1996, attached hereto and made a part hereof, based
following finding:
Findings:
1. The proposed zone code amendment is not in the pubic interest and is theref
consistent with the intent and purpose (subsection 21.10.015(a)) of the City’s
Dwelling Unit Ordinance.
