PLANNING COMMISSION RESOLUTION NO. 3898
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA,
RECOMMENDING APPROVAL OF SPECIFIC PLAN NO.
209 ON PROPERTY GENERALLY LOCATED NORTH OF
TAMARACK AVENUE, WEST OF INTERSTATE 5,
SOUTH OF CARLSBAD VILLAGE DRIVE AND EAST OF
THE SAN DIEGO NORTHERN RAILROAD, IN LOCAL
FACILITIES MANAGEMENT ZONE 1.
CASE NAME BARRIO SPECIFIC PLAN
CASE NO: SP 209
WHEREAS, the City of Carlsbad has filed a verified application fo
specific plan, known as the Barrio Specific Plan as shown on Exhibit 'V', dated FI
21,1996, attached hereto and incorporated herein, which has been filed with the P
Commission; and
WHEREAS, said verified application constitutes a request for a Speci
as provided by Government Code Sections 65450 et. seq. and proposed Chapter 21.8,
Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the P
Commission did, on the 21st day of February, 1996, consider said request on p
described as:
Portions of tracts 114 and 120 of Carlsbad Lands, according to
Map No. 1744; and portions of tracts 100,106, 107, 108, 110,
113, 114 and 115 of Carlsbad Lands, according to Map No.
1661; and portion of Block 77 of Town of Carlsbad, according
to Map No. 775; and portions of tract 231 of Thum Lands,
according to Map No. 1681; and Lots 1 - 13, 24 - 47 of Palm
Vista, according to Map No. 2969; and Lots 1 and 2 of
Tamarack Plaza, according to Map No. 5944; and Blocks B and
C of Alles Avocado Acres, according to Map No. 2027, all in the
City of Carlsbad, County of San Diego, State of California.
WHEREAS, at said public hearing, upon hearing and considering all tes
and arguments, if any, of all persons desiring to be heard, said Commission conside
factors relating to SP 209.

B) That based on the evidence presented at the public hearing, the Con
RECOMMENDS APPROVAL of Specific Plan, SP 209, based on the fc
findings and subject to the following conditions:

Findings:
I1 1. The Planning Commission finds that: 8
9 II a. the project is a subsequent project as defined in Sections 15168(c)(2)
of the State CEQA Guidelines;

b. the project is consistent with the City’s General Plan;
c. there was an EIR certified in connection with the City’s General Pla

significant in the prior EIR,

e. none of the circumstances requiring Subsequent or a Supplemental EII 1 CEQA Guidelines Sections 15162 or 16163 exist;
2. The Planning Commission finds that all feasible mitigation measures or
alternatives identified in the EIR for the General Plan which are appropriate
Subsequent Project have been incorporated into this Subsequent Project, for ir
the specific plan program for enhance pedestrian circulation implements tl
mitigation measure for alternate modes of transportation.
3. The Planning Commission finds that the project, as conditioned herein :
creation of a specific plan, is in conformance with the Elements of the City’s C
Plan, based on the following:
a. Land Use - The proposed planning areas implement the underlying (
Plan Land Use designations, preserving the neighborhood atmospht
identity of the existing residential area without reducing residential dc
or commercial use diversity.
b. Circulation - The proposed specific plan encourages alternative mc
transportation through upgrade and potential expansion of bicyc
pedestrian routes and, within the large existing rights-of-way, streetsca
additional landscaping will increase the circulation infrastl
attractiveness.

c. Noise - As an existing neighborhood, the only noise reduction requil
in the Barrio would occur with new residential projects of five or mo
that are sufficiently proximate to Interstate 5, consistent with th
Element of the General Plan.
d. Housing - The Barrio already contains a diversity of housing stock,
density and cost. In addition, the specific plan contains an inclu
housing program, consistent with Chapter 21.85 of the Carlsbad MI
Code.
e. Open Space and Conservation - No natural or manageable resourc
within the Barrio specific plan area, however increased landscapinj
public right-of-way will contribute to air quality. The specific pl
encourages voluntary preservation of historic structures.
f. Public safety - No geological, flood, airport or oil production hazard
within the Barrio area. The specific plan calls for maintena
augmentation of the existing levels of law enforcement and fire protc
g. Parks and Recreation - There are two school facilities, a baseball comp

h. Arts - While the Barrio already has some murals, the specific plan encc
the integration of artwork, such as decorative tiles, fountains and
furniture, into the architecture and streetscape of the area.
4. The proposed specific plan will not be detrimental to the public interest,
safety convenience, or welfare of the City since it allows the continued develc
in accordance with the General Plan while preserving the single family char2
the existing neighborhood.
5. All necessary public improvements to implement Specific Plan 209 have
already been provided or have been included as a program for
implementation.
6. The policies, programs, development standards and design criteria contained
specific plan address land use compatibility, recreational opportunities and
facilities. The proposed specific plan will constitute an environment of SUI
desirability and stability which is in harmony with the surrounding area. All
and park sites identified in the specific plan are adequate to serve the anti1
population and appear acceptable to the appropriate public authorities.
7. The area surrounding the Barrio, including the Village Redevelopment Area hi
planned in coordination and substantial compatibility with the proposed s
plan area. The proposed specific plan will contribute to the balance of land
that local residents can continue to work and shop in the community in whic

8. The Barrio Specific Plan is consistent with and implements the Carlsbad
Redevelopment Area Plan and Mello I1 segments of the City’s Local 1
Program as well as the Zone 1 Local Facilities Management Plan.
9. The specific plan will serve as the zoning ordinance for the Barrio. Cusl
development standards will function to enhance and strengthen the characte
neighborhood.
10. All requirements of Government Code Sections 65450 et seq. have been incor]
into the Barrio Specific Plan thereby demonstrating its compliance w1
applicable provisions of State Planning and Zoning Law.
Conditions:
1. The Planning Commission does hereby recommend APPROVAL of the Specil
(attached to Exhibit “V“, dated February 17, 1996, attached hereto) for the c
of Specific Plan No. 209 entitled “Barrio Specific Plan”, on file in the P
Department and incorporated by this reference, subject to the conditions he:
forth. Staff is authorized and directed to make all corrections and modifica
the Specific Plan documents, as necessary to make them internally consist(
conform to City Council’s final action on the Project. Development shal
substantially as shown on the approved exhibits. Any proposed develc
substantially different from this approval, shall require an amendment
approval.
2. Approval of SP 209 is granted subject to the approval of GPA 95-03, LCPA
ZCA 96-01, ZCA 95-05 and ZC 95-05. SP 209 is subject to all conditions COI
in Planning Commission Resolutions No. 3899,3900,3901,3902 and 3903.
General Conditions:
3. If any of the foregoing conditions fail to occur; or if they are, by their term:
implemented and maintained over time; if any of such conditions fail to
implemented and maintained according to their terms, the City shall have tl
to revoke or modify all approvals herein granted; deny or further condition is
of all future building permits; deny, revoke or further condition all certific
occupancy issued under the authority of approvals herein granted; institu
prosecute litigation to compel their compliance with said conditions or seek d:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA CREATING THE BARRIO
SPECIFIC PLAN ON APPROXIMATELY 180 ACRES OF LAND
LOCATED NORTH OF TAMARACK AVENUE, WEST OF
INTERSTATE 5, SOUTH OF CARLSBAD VILLAGE DRIVE
AND EAST OF THE SAN DIEGO NORTHERN RAILROAD, IN
LOCAL FACILITIES MANAGEMENT ZONE 1.

WHEREAS, the City Council of the City of Carlsbad, California has revie
considered a Specific Plan for the continued development of the Barrio; and
WHEREAS, said Specific Plan was prepared in compliance with the requi
of Government Code Sections 65450 et seq.; and
WHEREAS, after procedures in accordance with the requirements of 1(
state law, the City Council has determined that the public interest indicates that said
approved.
NOW, THEREFORE, the City Council of the City of Carlsbad, Califon
ordain as follows:
SECTION I: That the Barrio Specific Plan, SP 209, dated February 2
