HomeMy WebLinkAbout1996-02-21; Planning Commission; Resolution 3901I/ 0 0 1 PLANNING COMMISSION RESOLUTION NO. 3901 2 3 4 5 6 7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CODE AMENDMENT TO AMEND TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF CHAPTER 21.35, SECTION 21.35.020, INCORPORATING AMENDMENTS TO THE VILLAGE REDEVELOPMENT MASTER PLAN AND DESIGN MANUAL INTO THE ZONING ORDINANCE. CASE NAME: BARRIO SPECIFIC PLAN CASE NO: ZCA 96-01 8 WHEREAS, the City of Carlsbad has filed a verified application 9 amendment to the Zoning Ordinance as shown on Exhibit "X", dated February 21 lo 11 attached hereto and incorporated herein, which has been filed with the Planning Comrnissi 3.1 II 12 ll WHEREAS, the Planning Commission did on the 21st day of February 13 14 l6 arguments, if any, of all persons desiring to be heard, said Commission considered all 15 WHEREAS, at said public hearing, upon hearing and considering all testimc relating to the Zone Code Amendment ZCA 96-01; and hold a duly noticed public hearing as prescribed by law to consider said request; and 17 11 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Corn 18 19 as follows: 20 21 22 23 24 25 26 27 28 A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Corn RECOMMENDS APPROVAL of Zone Code Amendment, ZCA according to Exhibit "X", dated February 21, 1996, attached hereto an1 a part hereof, based on the following findings and subject to the fol conditions. Findings: 1. The Planning Commission finds that the proposed Zone Code Amendrr consistent with the applicable goals and objectives of the General Plan in provides consistency between the Barrio Specific Plan, the Village Redevela Master Plan and Design Manual, and the Zoning Ordinance and allows a precise implementation of the General Plan. I/ 0 e Conditions: 1. The Planning Commission does hereby recommend approval of the Zon 1 2 Amendment (Exhibit "X", dated February 17, 1996, attached hereto) Manual entitled "Barrio Specific Plan", on file in the Planning Departmt 3 incorporated by this reference, subject to the conditions herein set forth. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.35 OF THE CARLSBAD MUNICIPAL CODE BY AMENDING SECTION 21.35.020 TO INCORPORATE AMENDMENTS TO THE VILLAGE REDEVELOPMENT MASTER PLAN AND DESIGN MANUAL TO PROVIDE CONSISTENCY WITH THE BARRIO SPECIFIC PLAN, IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: BARRIO SPECIFIC PLAN CASE NO: ZCA 96-01 8 II The City Council of the City of Carlsbad, California, does ordain as 1 9 10 11 12 13 14 15 SECTION 1: That Title 21, Chapter 21.35, of the Carlsbad Municip: is amended by the amendment of Section 21.35.020 to read as follows: "The Carlsbad Village Area Redevelopment Plan as adopted by Carlsbz Council Ordinance No. 9591 and the Village Redevelopment Master Plan and ' Manual as adopted by Carlsbad Housing and Redevelopment Commission Resoluti ~ 272 and as amended by Housing and Redevelopment Commission Resolution No. ~ are hereby adopted by reference and incorporated into this chapter."
